hey guys,
M new to this. I have applied for a H1 B this year ....i went thru the pdf on bill S 1035 ...& it states the following:
Section 2(e) Prohibition of Outplacement
1. Employer cannot place, outsource, lease, or otherwise contract for the
placement of an employee on H-1B. (This prohibits any consulting work for
an employee on H-1B).
2. This applies to all the application filed after the enactment of this bill.
Does it mean that all existing consulting work will also be in danger?? M a bit confused as point 2 states that it will be for all applications after the enactment of the bill. Does that affect H1-b holders frm this year itself??

I completely agree with you.. I seriously dont understand what pride/ownership people feel by making 5% or best case 20% downpayment, Where the bank owns most of the house. It only truly yours when you have fully paid for it. To cite comparisons to our parents is plain foolish. Most of our parents bought their first homes by outright paying for it and having the home in their own name and not any BANK. Dont get me wrong, Not that i am pro renting and against home buying. I hope to have a bank financed home like everybody else in the near future. But i seriously would not feel any pride of ownership without actually owning it in the real sense. I fully own both my cars and feel proud about them :).

How wonderful that congress is finally introducing constructive bills to prevent 'consultants' mainly (but not only) from India from clogging up the H-1B visa system for honest skilled workers. The H-1B program is clearly intended for people WHO HAVE A SOLID FULL-TIME JOB OFFER AT THE TIME OF FILING THE APPLICATION. The whole body-shopping/visa abuse phenomenon is just disgusting. I wouldn't cry if any and all kinds of 'consultancy' activity were banned from the H-1B program. Someone stated that then they 'might as well lower the cap to 10.000/year'. Obviously not true. This bill clears out the infested issues of people illegally taking up visas on false premises. Good work!

I am not sure after reading your post above if you know the meaning of "consulting". To me it looks like you are focused on the narrow group that are labelled as "on-site" consultants. These are people you are hired by one company and perform their activities at a client site. Even among these people, not all have taken up jobs under false pretext.
First of all - consulting means performing work of temporary nature. It can be temporary due to any number of reasons - regular employee is on medical leave or on maternity leave, job is temp. in nature (an analogy would be that you hire a plumber to fix something in your house and you pay him either on a per-job basis or a per-hour basis) or you do not have expertise in-house to get the job done (the plumber analogy fits here too). Let me give you an example of each one of these.
Regular Employee is on extended leave

You are the owner of a company and your office manager is going on maternity leave for 6 months. You call a temp. agency and fill the office manager's position for 6 months. If one were to go by your definition, you would either fire your regular employee and hire a new one or you would hire the second person and fire him/ her when the regular employee is back or you would pay both of them wages

You are the IT manager in a big company and you have been asked to develop a new software application. To develop this application, you require 5 developers and 2 dbas over a period of 6 months. After the application is developed, you need only 2 developers and 1 dba to maintain the application. Or - you would just keep all of them on the payroll and the 3 developers and 1 dba will just be coming to the office and doing nothing. You would be a classic example of a person whose H1B should not be renewed - if infact you are here on a H1B. If you are not, then I am sure that you will find more support in forums like NumbersUSA.

The moment your I-485 is denied, Form the date of denial, your stay is considered unauthorized. You may have to leave soon as possible. If you accumulate more than 180 days and leave the country, you will be barred for 3 years from entering US. If you stay more than 365 days, you will get a 10 year ban. From the date of 485 denial till you leave the country, If you own a home, they know where to find you..if you decide to overstay...

I feel the same way Gondalguru. This is a globalised world or atleast so the US would like everyone else to believe. In that sense where you are should matter less than the contribution you are making, yet alas the immigration system is stuck in its 20th century President Kennedy era mindset of "reuniting families". I am not against that per se as it is a noble virtue, but when I see that to be in direct contravention of the aims and objectives of globalization which incidently the USA also champions so vehemently, I sense hypocrisy at worst or a conflict of policy at best.
My parents immigrated to a country which is NOT retrogressed (ROW of which I hold a passport) when I was 3 yrs old.
I was schooled and in every other way raised as such. Yet I was born in India................as you rightly point out by mere chance. Yet I am saddled with the consequence of waiting in line with every other applicant from India. If that were not funny enough, one of my close friends, his parents were in the USA in the 60s and left when his mother was 7-8 months pregnant with him, and he was born in India, now he has to go through the same line, he also holds a ROW passport. Should the majority of gestation count toward his citizenship?
These are difficult questions and the current policy is ill geared to deal with them. Those that win from them laud them and those that get hurt curse them. It is what it is..........dysfunctional.

We are not consultants.Most of the times we stick to one place. Either doing residency or postdoc we are usually in one place. Most universities are very rigorous with the labour certification process and residency is obtained via "match".
The consulting companies have been responsible for for flooding the GC process. Consequently researchers and doctors have to wait with the rest of the crowd. This new bills will turn out to be very advantageous to doctors and scientists ( in nonprofit organizations).
Would like to hear opinions for and against this view......

What do you mean "i am eligible for EB2"?????
A JOB is what decides EB1/2/3, not your imagined eligibility !!
If the job that you do requires no more than an EB3, then how are you saying your employer did something wrong? Why should you get to port to EB2 based on your "imagined eligibility for EB2"? Please explain that to me.
Remember, the JOB REQUIREMENTS should be there, it does not matter if you are a PhD from MIT...........

Provocative Ghauri was the title of an editorial that appeared
on this page earlier this month. Pakistan has named its missiles
Ghauri and Ghaznavi with the specific intention of taunting
India. These worthies' claims to fame and glorification, in the
perception of the Pakistanis, lies in the fact that they were
credited with plundering and devastating north-western India time
and time again in the eleventh and twelfth centuries.
In their enthusiasm to score brownie points, the Pakistanis have
got mixed up on chronology, they have produced Ghauri before
Ghaznavi. Also, they have perversely sought to commemorate these
Afghan rulers of Turkish descent in utter disregard of the fact
that most of the territories they plundered are their own - the
North West Frontier Province, the Punjab and Sind. The men and
women they tortured, enslaved, ravished and put to the sword were
their own forebears.
If Pakistanis wish to revel in the inglorious misdeeds of
foreigners perpetrated on their own soil and on their own
ancestors, they are welcome to twirl their moustaches in euphoria
and say: " Where ignorance is bliss, it is folly to he wise."
Indians may look forward to future generations of Pakistani IRBMs
and similar sophisticated weaponry named after the likes of
Changez Khan, Nadir Shah and Ahmad Shah Abdali. Alexander the
Great and Harshavardhan also have strong claims, but they might
be disqualified for obvious reasons.
In the course of his many abortive forays into India, Mohammad
Ghori is said to have been captured once by the forces of Delhi.
But Prithviraj Chauhan, king of Delhi, magnanimously let him off.
Legend has it - and it is widely believed in India - that when
Ghori eventually succeeded in defeating Prithviraj Chauhan at the
Second Battle of Tarain in 1192, he blinded him and took him in
chains to Afghanistan along with his friend, the poet
Chandravardai.
Ghori held a grand durbar to celebrate his victory. His prize
catch, the king of Delhi, blind and a prisoner, was paraded and
publicly humiliated. Deeply incensed by the treatment meted out
to his monarch, Chandravardai took refuge to a subterfuge. He
announced that though completely blind, Prithviraj could still
hit a target guided solely by sound, and he asked for permission
for this feat to be performed.
Prithviraj Chauhan was handed a bow and arrow, and Chandravardai
sang a now-famous verse which told him of the elevation and
distance to Ghori's throne. And thus, guided solely by sound,
Prithviraj shot his arrow through Ghori.
The legend may not be entirely true, but it would be absolutely
accurate to say that even after eight centuries have elapsed,
Prithviraj is regularly subjected to indignity in the land where
he was taken as a captive. I have seen it at first hand.
Many years ago, while travelling by jeep from Kandahar to Kabul,
I had to make a night halt en route at Ghazni. At the hotel, I
learned that there was a grand mausoleum over the tomb of Sultan
Mahmud Ghaznavi near the town, and I determined to see it. A few
extra Afghanis (the local currency) helped my driver to
comprehend the necessity of making a small detour the next
morning.
The mausoleum was indeed grand -judging by local standards - with
a high, arched doorway like the Buland Darwaza. lie tomb proper
was in a cellar about four or five feet be low ground-level. It
intrigued me considerably to note that there were no steps
leading down into the tomb. Instead, a metal chain hung from the
ceiling of the cellar. I was told that I would have to hold the
chain and jump down.
I asked for the reason for this peculiar method of entry. The
caretaker was evasive at first. But after much persuasion, he
disclosed that there was another tomb at the exact spot where you
jumped down. There, the infidel king of Delhi, Prithviraj
Chauhan, lay buried.

Ok there you go, now you cannot buy a house in India and you don't want to buy one here. Neither here nor there, but then i do not play with emotions as someone had accused me, so I wish you happiness whereever you are.
The evidence is overwhelming. The housing will go down so much that there will be hard lessons learned. No one will talk about investing in housing for a long time. I want to buy a house too. I just don't think you pay whatever the inflated price is demanded and throw away my hard earned money. You pay what is worth. Why do you insist that everyone has to participate in this ponzi scheme:confused: and keep the price inflated? Housing should be affordable and come to sane levels and I believe it will.

I am on H1 since 1999 with same employer except for a long interval of 16 months. I filed my labor in April 2001 (assuming 245(i) will cover me). I was not on payroll during Aug 03 to Dec 04. So my W2 for 2003 is 33% less than LCA and no W2 for 2004. I last entered US in Sept. 03
I filed my I-485 in June 07. I-140 was approved under PP.
My question is that what are my chances of being approved?
Also is there anything I can do now to rectify it?
I have no issues with the employer. He is willing to help me out in any way.
