USCIS has updated the processing dates pages of all the four service centers on September 28. Now the pages say that these dates are valid as of July 31, 2008 only.
If I remember well the processing dates information was more up-to-date earlier.
So looks like CIS has backtracked from their earlier published dates. They are telling us that they simply cannot tell what the current processing dates are. All they can tell us is that what applications they were processing on July 31.
What can we deduce from this? Is it good? Is it bad? Or no relevance?
It could be good as CIS might be processing July 2007 485 applications as of today? Or may be not.
Simply more confusion, as if as it is we were not confused enough.
Its hard to gauge what they are trying to do here by mentioning that the processing dates are accurate only as of July 31, 2008. But just attempting to make a few guesses. I might be totally wrong though

my lawyer said it was ok as long as I go back to work for them uon approval. GC is for future job, not current, according to USCIS Director memo.
The problem is my previous employer is not doing well due to economy :(
so I might not have a job upon approval

I am not an attorney but I was in almost similar situation.
1) You may get the priority date if you have the I140 copy. Some people say that even if you have lean no of I140 may be sufficient. As per law, priority date can be ported only if I140 is not canceled. But I read one article from an attorney which said that there is a circular in USCIS which advised officers to port the priority date if there is a I140 copy attached to I140 petition.
2) You can extend your H1 beyond 6th year if your GC labor PERM stage is pending atleast 365 days prior to your 6th year ending. You will get one year extension if PERM is pending and 3 years extension if I140 is approved
3) I think this is tricky, you can transfer only if new employer has filed for PERM and got an approval. I am not fully sure about it.

YOU: If thats a valid visa until 2009 you can travel without AP. Else, you can travel but will need H1 stamped.
YOUR WIFE: If she needs H4 stamped, she can get that done and re-enter.
If your travels are not urgent you could wait for AP and save couple hundred bucks!
But dont you need to wait for AP approval to travel if you are in AdjustmentOfStatus Phase?

I needed some advice on this situation I've found myself in.
I have a PERM application filed with my current employer (EB2, Oct 2007). Like most EB2 apps, mine is under a business necessity audit and we have filed an audit response for it. My lawyers are pretty sure that we will clear the audit. Guessing from , the response may be 2-3 months away.
Now I have a second offer from another company. Everything about the job and company is better than my current, but the legal team at this second company says that they will only file in EB3 (even though the job requirement says Bachelors + 8 yrs). They say that they have other EB2 audits going on and have made it a policy to only do EB3 going forward.
I'm on the 5th year of my H1 (don't ask, had a PD of 2005, caught up in BEC and got laid off last May, refiled Oct 07 with the current employer) and this probably will be the last chance for me to change jobs before I cool my heels and wait for the repercussions of the July Fiasco to be over with.
I can't decide on weather to keep my existing EB2 job or take the new offer and step down to EB3.
Please help!

My check was cashed on 08/31. Based on the receipt numbers on the back of the check, online status shows that receipts were mailed on 08/31, but I haven't received till date. On 10/01, I called customer service and made them create service request. No progress so far. I am planning to call sometime next week and find the status of the service request.
Is anyone in the similar situation of not receiving the receipts even after check has cashed way back.

Sorry for taking this discussion into different side..instead of opening a new thread i felt my question is related somewhat to this...
I am planning to change to new employer in february 2009 and used AP on Nov 2008. I am planning to ask new employer for H1B transfer instead of EAD as my H1B is valid till Sep,2010. Will this be a problem as i already used AP..some where i read that, i may jeopardize my 485 application, if i do H1 transfer in this case, as i used my AP....
I will talk to lawyer soon on this and let u know but any insight is helpful from you all..

I agree, international schools mirror US/UK formats and the transition is easier. My neighbor returned with an 8 year old kid. She had problems with the second language (hindi in her school, tutions helped a bit) she was fine with the rest. The parents had planned in advance, be prepared for fact that even if your child is among the best here, he/she will be average there, the learning standards are very high in good schools. BTW in india children are already exposed to writing in the second language from KG
If you contact the school they will email you a list of academic standards for each class, you can go through the list and spend some time working on your childs weak spots (if you want a URL for such a list let me know or search for DPS pune or any other well known school). Its different there, but there is more freedom and children enjoy it more (there will be pressures, related to mixing with children and language, but children are more adaptable than us.). Be prepared for a learning curve and an adjustment period thats all.

I joined another employer on H1b this May. I did not use my EAD since I wanted to maintain my H1 status. My employer is willing to support my I485 but I have not informed the USCIS about my change yet.
What does that mean? Have you used AC21 or it is not necessary.

This is a problem. When we try to keep the forums clean, people complain and talk about 'freedom of speech' and that moderators act like dictators. They go and talk rubbish about IV elsewhere.
When we are flexible and allow people to express, people start complaining about abusive comments and posts.
One anonymous user commenting against other anonymous user is hardly of any consequence. To come to IV or not come to IV is your decision. Remember IV is not about forum or red dots or green dots. It is a platform for everyone to meet and work towards fixing the system. If a person is committed to the cause, he would not be bothered by any distraction.

I am in the same situation. My case reached NSC on July 2nd. But received receipt from CSC with WAC#. After that received EAD. Yesterday received mail stating that my case is transferred to NSC for jurisdiction with RD Aug. 28t and ND Sep. 6th.
My I140 got approved few months back before I485 applied date.
