Logiclife, Looks like the statement that USCIS have to accpet the 485 applications all month on July inspite of availability of visa might not be true anymore. See below link
http://www.immigration.com/fromtheagency/usciseb36287.html
I'm really concerned now, as like many I've also shipped my paper work to the attorney, but have NO control on when they are going to file.
Anyway, we have to deal with all this.
That's bad...really really bad. We spend so much time and money on getting documents ready, medical records and all that. In the end, something like this happens and our bad luck continues to grow.

Feel Free to suggest your recommendation.
I am sure IV has more experience in this than anyone else in this forum. So I think its better it should come from them. :-)
This whole doc is put out well. They just need to update wherever necessary. That's it.
And as for it a law change: whew!. But can work it out!

Hello
I think all the backlogged labor applications are going to clear. But people like you may get very less time to apply maybe 15 days. My advice to you.
Start preparing to apply if you have not started already.
1. Do your medical exam. It is valid for 1 year.
2. Collect important documents. Birth certificate is most important.
Has to have .
a. In English
b. Need to indicate that has been prepared from original registration record.
c. Need to have your name, both parents names,
d. Registration date with date,month,year.
3. Fill up your forms.
Dont be dejected. This is the time for action.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

Who should be contacted to get the material for meetings with senator/congressmen? Can someone point me to a link here on the IV site?
You can send a personal message to "StarSun", who will give you the material and instructions.

Called my local congressman's office and left a voice message. Called the offices of Bob Menendez and Henry Cuellar. Rep. Menendez's staff noted down my message and said they will pass it on. Rep. Cuellar's staff mentioned that some of the contents of the bills are contradictory to the things that he supports and got into talking about comprehensive reform. I politely listened to him and reiterated my request, mentioning that his support was very important to get moving on immigration reform. Have to call the other members now. Seemed quite daunting initially However I will try to finish calling the other members as well. Do we still call the office of Ciro Rodriguez ? Going by the postings, they seem to be against the bills.

I agree with the contents of the post. Personally, I have been writing letters regularly to the Congressman, the Senators of my State and also to the President. In most cases I have received responses.
Many of you may not find my observations interesting or you have also come across something similar. This is however for those of our friends who are yet to write to law makers!
Following are some of the obesravtions which I would like to share:
1. Letters posted (not emails) seem to be read and replied. (Ofcourse, most of us are now so much used to email that it is difficult to print and post, but I still think it is worth the effort)
2. Unless the subject line refers to a "specific bill no." the answers are very generic. In fact many such responses are not relevant at all
3. Whenever the letters have been to the point and within ONE PAGE, they seem to draw attention.
4. I have tried to meet my Congressman for about 2 years, but in vain. However, over a period of time I have been able to develop some friendship with his immigration assistant. They are the people who prepare notes and present it to the Congressman
5. Recently I got a response from one of the Senators on the S1085 bill. He is a Democrat and has stated that he is supportive of the bill and that it is currentlyundergoing "judicial review by the Senate". I really do not know what it means, though!
5. Regarding CIR I got a clear letter from Mr McCain stating that unless the "borders are secure and sealed" CIR does not make any sense. I have once again written to Sen McCain that we are legal immigrants and would like to seek his support as well as thatof all Senators and Congressmen, from both parties. I am yet to get a response. Once I get a response I will share it with all of you
6. I am no writing a 2 separate letters (one about the new bill about passing on Lottery Visas to EB) and also another about the fate of of HR 5882. I would also be writing the Congressman who has sponsored this "Lottery Visa" about the HR5882.
The task is uphill and very difficult. We have no option but to try the beaten track. Many of us are here for more than a decade and the end is never so near. Time does not wait and we cannot board a time machine to get back in time! I am one such person who left UK and came here! Had I continued there I would have become a citizen 2 years back!
Perhaps we can try the Gandian method of "mass satyagraha" which is a very peaceful means, to highlight our situation. We can do it in summer, may be in June / July and start working in this direction. Not sure how many will scoff at me, but perhaps it is worth the try.
GOD BLESS all our friends who have been patiently waiting for ages!
Best wishes!

I have failed to see where IV has been showing discrimination or bias towards Eb2 versus Eb3?
Not taking up a specific Eb-3 cause does not tantamount of neglecting Eb-3. Has IV done something in past 'proactively' for only a certain category of Eb? If not, then how can we accuse IV of ditching Eb3, at the same time?

1) Fast-track GC process for Masters degree holders from US universities. This will be the least controversial, boost admissions (and money) flowing into universities, and clear up backlog in regular GC queue. Its a win-win and most senators, congressmen have voiced support for it already. We can get very good support from University lobbyists also (if they exist!!).

Hi everyboby,
I have question about the "deadline" to get non-profit job. Now I'm on OPT and looking for non-profit job. My OPT will expire on 1/14/2008.
Do you know how long will I get the H1-B visa after I apply for it? If my OPT is expired but the H1-B visa has not come yet (but applied for it), am I still legal to work?
My question is: if it take, for example, 3 months to issue the visa, and I still have not get a job on 10/14/2007, then I should give up and find a community college to get a F-1 visa, right? Am I correct? So, is there any "deadline" in my case?
Please give me some advices....Thanks!

This is an extremely bad bill. With India dominating not only the H1 visa quota and EB green cards applications but also body shops and consulting companies; eliminating the per country quota would massively and unfairly flood America with workers from India
Many defenders of the bill used flawed socio-economic reasons to justify their *shameful and selfish agenda. Unused visa for ROW (Other countries) is NOT because there are not enough skilled workers from other countries but because the uscis/dhs use the quota to conservatively hence at the end of the visa year there are still many quotas left. ROW priority date has never been current for a very long time
Would you prefer to work with 7 immigrants from India and OR 2 from India, 1 from Germany, 1 from Zimbabwe, 1 from Argentina, 1 from Slovakia and 1 from Burma? The bill will not only hurt professional immigrants from other countries but also will hurt diversity, the core and sacred believe of American people
What a lame logic.
How does it matter from which country is the doctor/engineer/scientist is coming from
and with whom I am working.

If the CIR bill passed then we will see huge forward movement else nothing discussing for EB3.
CIR is not going to help EB community unless a miracle happens. It is for illegals only just like last time. Worse comes to worse it is going to put more hurdles for H1b and EB folks.
I think we are better off without CIR.
In any case there is no hope for CIR . A number of senator and congressmen are opposed to it and the wide public also doesn't support it .

Speaking for myself, I'm not seeing the value.
I see IV right now going off and tilting at windmills that will have little effect. Stuff like the I-485 without current PD for example, will serve to both alleviate the immediate issue of backlog, and make those responsible less likely to actually fix the problem, all while creating a permanent under-class of immigrants who will spend decades waiting for their permanent status.
So...when I see them advocating for things that will make a difference, I might consider contributing at that time.
Dear Sir, You are EB1C, chargeable to CANADA..you should have your greencard sooner than one can say Mississipi..or Schenectady..or Connecticut...or whatever.
I am not accusing you of apathy, but you may not be able to understand the anxiety, pain and frustration that a person who is an EB3 or even EB2 chargeable to India or China. People in such a situation will tend to grasp at the straws.... if not the whole bale of hay.
