weldon springs, follow my posts. you are right, TSC is doing a better job. look at my previous post, they even renewed my Ead from the date of expiry of the previous one, so that we dont pay money for nothing. my EAD got renewd in exactly 4 days..
I am feeling very envious of people having their applications processed at the TSC. TSC as seen by the examples above are renewing EAD in 2 weeks.
However, NSC is taking 2 months to process these EADs. There is a big difference between processing logic at NSC v/s TSC
I think the employee diversity at TSC is big compared to NSC. Therefore, people add their heart to work and processing is faster. In other words, Intent is pure. If you pay a higher fee for a service you get the return.
Contrast that with NSC. The employee diversity is poor. Employees are working just because it is a government job and their intentions are questionable, therefore a big lag in processing.
Hope the courts teach NSC a lesson, that nobody is above the law and they should be processing cases quickly as compared to their TSC counterparts. Hope somebody is listening.

my company lawyer responded to my similar question saying they too fear the mid month retrogression, and will try to file ASAP. However, the explanation offered in other posts in this thread (notably, logiclife and shantak) does sound compelling. as someone said, file asap if you can. if you cannot, do not worry, as 1. it won't help and in 2. my humble opinion, shutting the door for ALL within the first month of opening the door for ALL, will be a shame, and will set a very bad precedent, so most likely they will wait at least until end of July before the shut the doors.

Folks,
I am a passive IV listener and this is my first post. I was not expecting my GC to be approved for atleast a year since my priority date was Dec 04 and this is the first time I am current. Also, I applied for I-485 only last year in Sept 2008. So it was unlikely they will look at my case since there were people before me from 2007. However as random as they are, I got the e-mail today that they ordered the production card for me. I am EB-2 and my case was st forward though, no RFE's ever and I have not changed job as I am pretty happy where I am. Anyways, all the best to the folks waiting.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

The lady was friendly and chked the status of my application. First she informed me that it was under review and then she told me that on Aug 3, it was assigned to an IO. I didn't ask any further questions as the news that my case has been assigned to an officer made me happy. I just wished her a good day and left.
Now, I'm beginning to wonder if I shud have asked more questions such as about Namecheck, FP etc...But I donno its with an IO and I guess I'll know the actual status shortly.

My husband and I are both on H1 now. My H1 will not expire until 2009 but I plan to quit my job and transfer to H4 for family reasons. Suppose I quit from H1 on June 1, 2007, what is the best time for me to file I539 to transfer to H4? Do I need to file right now or just anytime before June 1?
Another question is that if I quit H1 on June 1, but the change of status to H4 will not be approved until later, say, September 1, 2007, what will be my visa status between those time? Will I be considered out-of-status?

I have booked my tickets. I will fly in to DC by Saturday noon and fly out Monday evening. I got greened last year and I owe a lot to team IV and its members. I used to be very active on IV and always a good friend to Pappu, Aman, Jay and all other IV members.
I have done lawmaker meetings twice in the past and would like to share my experiences with you all and also help with talking points etc... based on experience.
I appeal all IV members to take advocacy seriously. Changes come only through persistent efforts and thats exactly what IV is doing. Most IV core team members already have green cards or are citizens and they don't need to do all this, but they are doing it because they believe that persistent, sincere, honest efforts would definitely reap benefits.
Please contact your friends, relatives and co workers. Conduct local meetings, explain to them about IV and what it is doing. As IV members are well informed and understand the situation - especially EB3 folks, ignoring such events and not doing anything active is not an option.
Why is the advocacy day so important? This is politics 101. One can be a great doctor, great engineer, great scientist and anything, but at the end of the day, we need to understand the dynamics of things and how things happens and do things accordingly. We are all great achievers primarily - we went to good schools, worked hard, got good jobs, able to migrate to the US and have excellent leadership qualities, we have good friends, nice families, great kids and cannot complain about life in general. But getting delayed on GC is very frustrating and if we do not understand what this is all about and what it takes to find a solution, then we are just missing that essential thing in life which is "what we would need to do to change things that helps us all". Reducing GC backlog and streamlining process is a win win situation to all and such message needs to be conveyed in an appropriate way. It is our issue and we need to take it up and not expect things will fall in place automatically.
These days I see so many campaigns on facebook, twitter, etc... and the world is not like before. Public voice and opinions are being taken very seriously and if we do not live up to the times, then we basically lose big time.
Do we want to lose it? I am sure we want to win.
Can we all unite and help ourselves? I am sure we will.
Can we all come forward? I am sure we will.
Folks - we are all creative in different ways. Lets do what we can to further our cause. I wish a lot of people change their minds after reading my message.
I will keep posting inspiring messages when I get a chance.

Please help.
I am in the process of filing PERM. Ads have been placed etc and all the
formalities completed. Now, we are at a stage where the forms have to be prepared, signed and submitted. However, i am very unhappy with my attorney. He is unethical and i am afraid he will screw me up. So here are the questions
1) At this stage ( not yet filed PERM) but on the verge of filing, is it possible to change attorney or is the job order etc specific to the Attorney.
2) In form ETA -9089, in the Alien Work Experince section, it says to give the name of the aliens supervisor and the employers phone number.
MY attorney says this is not required. Any thought on this. Did your forms mention this ?
3) I am afraid my Attorney will deliberately mess up the form. What should I watch out for in the form before signing on it ?
4) IS there any redressal system at all in this country for Attorney Malpractice ? Anyone taken this route before ?

This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.
