    Labor substitution is not an option anymore. I have PD Dec 2002 EB3 India working on EAD.

    Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

    India looses talent when we immigrate, it is unfair to ask them to help expedite this

    Thanks for your reply.

    I thought by using EAD i will save my 6 months on H, incase anything goes wrong with 485 i still hv 6 months on H left.

    looks like its a grey area .... will differ it to opinion from any lawyers.

    But my latest paroled stamp on AP it is : Dec 05, 2009.

    You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.

    Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved.     How do i find out if a RFE has been issued on a case?
    Does USCIS "check case status" mentions it? My lawyer is one heck of a person and i have to keep track of my case.

    We went for FP today and my wife had henna on her hands. I was concerned about it but it never was an issue. The FP went as if she had nothing on her hands instead the FP people pleasently talked abt henna.

    We went to the Atlanta office, the staff was pleasent, work flow streamlined and we were done in less than an hour although they looked and checked our hands almost four times for bandages and cuts.

    The U.S Department of State (DOS) has advised that there are no more employment-based visa numbers available for fiscal year 2009, which concludes September 30, 2009. Unless Congress extends the sunset provision, individuals in the EB-4 non-ministerial category are unable to file Form I-485 Adjustment of Status Applications or consular processing applications after September 30, 2009.

    While the I-360 religious worker petitions (ministerial and non-ministerial categories) may still be filed before September 30, 2009, given the unavailability of visas in the EB-4 category the month of September, the Applications to Adjust Status (Form I-485) or applications for consular processing will not be accepted this month. Thus, adjustment of status applications that remained pending will not be approved unless a visa number had already been captured.

    Individuals in the EB-4 ministerial category are eligible to file Adjustment of Status applications until October 1, 2009, when visas in the EB-4 category become available.     They are not liable to pay from the the day application was sent.

    Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.

    In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

    1)My I 94 expires in 2 months.I don't want to extend H1 and I want to use EAD.So how can I extend my I94 if I start using EAD?

    2)I finished 4yrs of stay on H1B. If I don't extend H1B now and start using EAD, if by any reason my 485 denies in future, can I switch back to my H1B and work for the remaining 2yrs on H1B?

    An RFE got generated on my wife's 485 application. Our company lawyer filed our 485 applications. Does anyone know who gets the RFE notice? Will it be the lawyers office or us?
