I filed on March 26th in TSC (paper filing). Got receipt dated April 7th. Still waiting. I cannot continue the job as my H1B expired. Anybody knows what should I do to get it expedited. I guess people at USCIS are very unpredictable and work according to the mood. I did not anticipate this as earlier I filed EAD for my wife and son and I got it in three weeks.

If the IV core and its advisory board don't want to do that, they must have some reason. I trust the IV core and its advisory board. I am sure they know how politics works better than you and me. The existing bill may have a small chance to pass. EB3 can still benefit from that at least to some extent.The idea you preferred has no chance, given the harsh economic situation and anti-immigration sentiment at this time. In this case, EB3 will have to wait forever. Now, which one do you like? I think people should be realistic.
My friend there is no need for you to get antoganized with me because what i said in my previous post is more a message to everyone on this forum and is not anything personal against you. In fact i am surpirsed that you are even discussing opening up teh 55K to everyone.
I know you did not write this bill (Would have been nice if you did because you listen to the other persons argument which is sadly lacking in this forum from a long time)
There is no way we can challenge Rep Issa on this clause. We are just individuals. Yes a forum like IV can but question is will IV core do that? And the fact that you are perfectly OK with IV Core modifying the bill only shows good intention on your side but sorry to say this (You would be very naive to think IV Core will entertain such ideas)
Lets just say if IV Core does what you had proposed it will show maturity of thinking of of the group and i for one will be pleasently surprised. Not to say i am waiting with bated breath for that to happen. Call me cynical but thats the way i have seen things happen here

Hello!
My wife currently has a H4 stamped in her passport. She is India right now and is planning to travel in June 2007.
Now her H1 will most likely be approved. Does this mean she has to go for stamping her H1 VISA or can she travel on her H4 (valid till 2009)? Is it required to carry the approved I-797 for her H1?

Anyone received payment processing errors in the last couple of days on the E-File website? For some reason, while trying to complete payment for my AP e-file, when I try to use the credit card option, I keep getting an error that the e-filing payment processing server is unable to process payments at this time. I have been trying every hour for the last 2 days...and the stupid USCIS Customer Service number has no options to report this error...

All those who are still waiting in BEC black hole, I feel for you. I was stuck in BEC for four years. Only managed to get out a couple of months ago after they allowed TR cases to be converted to RIR.
I tend to think the same way as chanduv23. Our final goal is a Green card, and it may still turn out that the people who are currently still waiting in BEC may end up getting their GC in hand before many of the ones that can apply for 485 in July.
The reason is that USCIS has clearly stated that it will retrogress big time in September. So, people with recent PDs may get to file their 485 but may have to wait for a long time for their PD to become current again to get the approval notice (folks, I am not wishing ill against any group here! I wish we all got our GCs ASAP. But since that is not going to happen, just trying to analyze facts). On the other hand, if BEC comes through with their sep 07 prediction, then these people with much older PDs may be able to apply for their 140/485 at that time and may end up getting their GC 6-12 months later because their PDs will still be current at the time of approval (Of course, this is assuming that they will not get caught in the Name Check Black hole)
So, all those who are still stuck in BEC, please hang in there, your day of freedom will arrive (maybe sooner than you are currently thinking).
My prayers are with you all guys who are stuck at BECs and waiting for more than threes like I did. As someone said, Good things come to those who waits.

You can use that labor. Here is how you would proceed.
Comply with the advt requirements and whatever else is pending - in couple of months you will have your old labor approved - once old labor is approved , just follow the process normally as you would do.
Since both labors were filed in same category , you dont need to do PD porting or anything. Life is pretty simple for you ( wrt PD porting ).

I read that there are 2800 EB3-I visas a year, or about 233 visas per month. Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:
Sep-2010 : 10-Dec-2001
Sep-2011 : 31-May-2002
Sep-2012 : 15-Sep-2002
Sep-2013 : 01-Jan-2003
Sep-2014 : 01-Apr-2003

Guess they'll just move it forward just to attempt to use up all available numbers. Neverthless it's positive for many who have been waiting. But it just makes the future predictions tougher. Lets wait for Sep-10 visa bulletin and then do another round of predictions after the I485 inventory is released.

EB3 ROW is at Jun 2004. If there is to be any chance of spillover from EB3 ROW, EB3 ROW would be close to current, at least much farther than 2004.

Retrogression in Various Steps of the GC process
While January 2005 was the first time since July 2001 there was retrogression for the EB-3 category (01/01/02 for both China and India), the US continues to maintain protectionism through their immigration system.
Retrogression in Labor Certification: Between 2002 and 2005, there was severe retrogression as far as labor certifications were concerned. Then came the PERM in March 2005 and for a couple of years, they boasted labor certification with 3 to 6 months time. Of late I think it is taking more than 6 months for LC approvals even through PERM.
Retrogression in I-140 Approvals: I do not remember when the USCIS suspended the premium processing for I-140 but even before they did that, they managed protectionism by delaying the approval of I-140. As per some one's posting, it is now taking 14 months for an I-140 approval.
Retrogression of I-485 Approvals: Post July 2007 VB, even a 1st year engineering student from India, studying the American immigration system, can tell you it could take years (not the current 6-9 months processing time) for approval of I-485s. The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape 'protectionism-tainted' FBI name check delay.
I may sound like quite a pessimist, but add to all this the possible denials for PLC (permanent labor certification), I-140, EAD, AP & I-485s.

I had similar situation recently. I tried calling CGI houston several times with the nos. listed on the website and no human would answer. If you are homesick, these nos are perfect to give a call. It would just play you a long Indian Classical music over and over again. My ears were still ringing with the music after the call, you can imagine how many times I had called!
Once I was lucky to get through, but not for much help. If anyone picks ups by chance, they would be rushing you like anything and refer you to consult the website.
It is amazing!

I just don't see why you jumped all over the guy. The lawyer told him something that he thought was horrible - and rightly so, based on the info provided to him by the lawyer. So he posted that, in hopes to inform his fellow members about this situation, and probably he was hoping someone would confirm or disprove that. Instead everybody jumped all over the guy. We may all be stressed out with all this CIR / July bulletin roller coaster, but let's not too crazy and devour one of our own. He ain't the one who caused you the pain in the first place.

There are a lot of 2003 and 2004 filers still waiting. EB3 should be much more than EB2 because during this period, there was no visa retrogression and most people did not care about the category. Even some of those EB3's converted to EB2's, it did not really reduce the visa # demand or made the EB3 line shorter thanks to the infamous Labor Substitution. Needless to say the existing name check backlogs as well as the filing rush right before PERM. My guess is it will take at least a year for EB3 to move beyond 2004.
