This request is regarding workers on H-1B:
Problem: H-1B status ends the moment a foreigner worker looses his/her job, and s/he is effectively out of status. The foreign worker has only 10 days to wrap up his/her affairs and leave the US. 10 days is just not enough time to wrap up five or six years of living and move.
Solution: The foreign worker's status must automatically be extended by 90 days in the event of job loss.This gives the worker enough time to get his/her affairs in order -finances, car, house/apt, kids in school, etc.

I raised a SR yesterday and here is the email i go today
"The status of this service request is:
Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided "
Has anybody received something similar? Seems canned and asking to wait for another 6 months holy cow?What is the next step Info Pass?
I would suggest taking an infopass appointment and also contact your congressman. No guarantees but those are two options so why not try both.

I have booked my tickets. I will fly in to DC by Saturday noon and fly out Monday evening. I got greened last year and I owe a lot to team IV and its members. I used to be very active on IV and always a good friend to Pappu, Aman, Jay and all other IV members.
I have done lawmaker meetings twice in the past and would like to share my experiences with you all and also help with talking points etc... based on experience.
I appeal all IV members to take advocacy seriously. Changes come only through persistent efforts and thats exactly what IV is doing. Most IV core team members already have green cards or are citizens and they don't need to do all this, but they are doing it because they believe that persistent, sincere, honest efforts would definitely reap benefits.
Please contact your friends, relatives and co workers. Conduct local meetings, explain to them about IV and what it is doing. As IV members are well informed and understand the situation - especially EB3 folks, ignoring such events and not doing anything active is not an option.
Why is the advocacy day so important? This is politics 101. One can be a great doctor, great engineer, great scientist and anything, but at the end of the day, we need to understand the dynamics of things and how things happens and do things accordingly. We are all great achievers primarily - we went to good schools, worked hard, got good jobs, able to migrate to the US and have excellent leadership qualities, we have good friends, nice families, great kids and cannot complain about life in general. But getting delayed on GC is very frustrating and if we do not understand what this is all about and what it takes to find a solution, then we are just missing that essential thing in life which is "what we would need to do to change things that helps us all". Reducing GC backlog and streamlining process is a win win situation to all and such message needs to be conveyed in an appropriate way. It is our issue and we need to take it up and not expect things will fall in place automatically.
These days I see so many campaigns on facebook, twitter, etc... and the world is not like before. Public voice and opinions are being taken very seriously and if we do not live up to the times, then we basically lose big time.
Do we want to lose it? I am sure we want to win.
Can we all unite and help ourselves? I am sure we will.
Can we all come forward? I am sure we will.
Folks - we are all creative in different ways. Lets do what we can to further our cause. I wish a lot of people change their minds after reading my message.
I will keep posting inspiring messages when I get a chance.

I love to go for long walks, so count me in for that part! Not sure if I can commit myself to the SF event... need some more time to make up my mind on this one!

As far as your concern about being able to do a 5K walk, i can assure you that if you are already able to go for long walks, a 5K will be right up your alley. The 5K is 16 weeks away and with our friends from Runner's World Online, you can actually train to run or walk a 5K within 6 to 8 weeks. So this is completely do-able. A 5K walk is only 45 mins.
When I was a kid in India, some evenings, I could not get a BST Bus to get home from school, so I used to walk from Matunga Circle in Bombay all the way home in Chembur. I was 12 years old and and it took me less than 2 hours. :)

Today I have contacted Ron Gotcher and here is his response.
1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.
1. Rather than every one sending separate letter, let us send only one letter and every one signed that.
2. Let us create one yahoo group, send all your infomation, Name and adress.
3. Draft a letter to OIG, attach all our information.
4. Based on the response let us decide our next move.

I think you can file for I-485. But, once your GC gets approved you will have to move back to VA for a month or so and work from there. Remember GC is for your future job. Anyways....talk to an attorney.

9:15pm is a good option. red-eye means late night flight. There are a number of options from BWI to downtown DC. A bus and light rail train will get you there in an hour.

Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.
1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the �Other Worker� Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.
Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.
To be honest with all of you, I was really disappointed in the message from AILA. In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.
This attorney is right. DOS is the one that manages the numbers. Not USCIS. USCIS is just a robot in processing the applications. DOS has legal obligation to issue not more than 140K EB visas per year. They may issue less than 140k visas per year. That�s is alright, no one can question. They can not exceed the limitation. The purpose of all category current in July is to approve all eligible 485s that were pending due to lack of visa numbers. It is not meant for accepting tons of 485 in July. If they do not make current for July, they cannot issue 40,000 visas before the end of FY. USCIS ombudsman scolded them in wasting the visas, despite the heavy demand. That is the reason why it is current. It is �current� not for accepting the tons of 485s. Also, Ombudsman recommended strongly that USCIS has to accept only correct number of 485s to process within time.
Even AILA failed to understand the difference between law and regulation. The regulation is a detailed procedure to implement the law. If they violate law, then they are in trouble. If they violate regulation without violating the law, it is perfectly alright. But only thing, it is not transparent and ideal way of handling the process.
Again, visa bulletin is an advisory notice by DOS to manage the numbers. DOS can instruct any time USCIS to accept or not to accept any 485s in between two visa bulletins.

Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
We need to stand united and raise awareness and sign up for the monthly recurring contribution.
I understand that some of you do intend to contribute and have contributed generously in the past,
But here are some mindsets, All of us fall in these 4 mindsets.
1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
2) I have contributed enough.
3) I will contribute if I feel like, when I see something comming out of this effort.
4) I do not have to contribute.
If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can better plan.
Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.
Category 3) This has been discussed, I do not want to talk about this category of members.
Category 4) Again - No Comments-
Lets show the core team that all of us fall in the first 2 categories.
The last thing we want the core to do is bite their fingers over funds. We do not want the core to get stressed out over funds. They have enough real work to do already.
Inspite of being a serious team player, and a generous contributor it took me two days to sign up for the recurring monthly contribution program, so I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. But this is our last chance, I urge you to be one of the 1000 people we need for this effort.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
I totally feel for you right now. A lot of people are celebrating the unexpected news, and those that have applied for labor possibly MUCH earlier are still stuck.
Let's hope that the BEC keep to their new revised deadline and the Visa Bulletins remain rosy for you
