Thnks, for the fax # , hope I get my EAD/AP soon, I had applied for AP on 4/9/2010 and EAD on 4/15/2010. My EAD is valid till Aug 3rd . My wife's EAD is till July 21st.
I sent both to Phoenix lock box as Im in CA. My checks havent been cashed yet, both were paper filing , in the past the checks used to be cashed in a week and I used to get the receipts in the mail within a weeks time.
Has any one been in a situation where they havent got EAD renewal in 90 days and has been successful in getting the interim EAD from the local USCIS office? Plz post their experiences here.

I am with you Sanhari. I will do the same..
I am writing to the local congressmen, to request USCIS to apply the spillover visas to EB cases with older priority date first (irrespective of it's category or country). I hope this will help, if lot of these local congressmen/women contact USCIS to handle this spillover in a fair manner, allocating to older priority date cases first irrespective of category or country. All EB3 folks please take some time and do the same writing to your congressmen about this issue.

This has been a posted by a fellow member 5 pages ago.. ARE THEY DIVERTING EB3 NUMBERS to some other categories?
Pappu or someone knowledgeable about backlog..please answer.
EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.
my 2 cents
Note : If EB3 ROW has 30k visas per year and pending EB3 ROW 485's are only 50k.. why it is still hanging in 2004. God only knows !!

My lawyer told me my labor got filed yesterday.
PD July 26th.
I have 2 questions...
I am in texas, where center do they file, and what is the way to find out how long does it take for approval?
I have been getting some reports..big delays and fast approvals.
In the rare :) possibility that I can get my approval with in 17th of Aug..
can I file 140 and AOS..in the window of oppurtunity that is currently open.
Any help is really appreciated

Wow! it sure varies by a lot..I just spent $190 for the same
It varies depending on the physician. I paid $475 for everything blood work to test immunizations + TB test + Physical exam. This is for one person.
Same physician, my friend went with all medical records and she charged only $250 for doing physical and TB test.
I got the report with in 3 days. Hope this helps. Good luck.

Shyam: Thank you for your hospitality. You have made me & manish feel at home. Those dosa's were tasty and we also had nice conversation about general issues in the kitchen.

My wife attended the rally yesterday and this is what she wrote her friends who didn't come to the rally!
Yesterday, Shyam, Isha and I spent all day in DC as part of immigrationvoice, a grassroots non-profit organization that acts as an interface between highly skilled immigrants and the legislative and executive branches of the government. It was a wonderful experience. Over thousand people met at the foot of the Washington monument, and walked all the way to the US capitol. The organization had made good arrangements. Its amazing how people from all over the country were there and very few local people. One South African couple had driven on Monday from Indiana and came to the rally to celebrate the husband's birthday!! He wanted to be a part of this rally as a present for his birthday. We had 2 people - Manish and Sri, from New Hampshire staying with us on Monday who came just for the rally. There were some british, some chinese along with we Desis.
The need for the rally brought to light the real issues -
Most of us may have applied for our I-485 Step 3 in the greencard process, in July 2007, but that doesn't mean we will get our green cards soon. The govt accepts only 140000 applications a year and only 9000 are allocated to Indians in all categories.
Lawmakers and congress are confused when they think of immigrants - they club legal and illegal together. Even the Seattle senator who addressed the gathering yesterday made the same mistake. He said its good that you guys are out here so the congress can see its not only the janitors and others who have immigration issues but also highly skilled immigrants! No mention of legal. He used his time to promote the democratic party and we tried to remind him we don't have voting rights even though we pay the same taxes and work like everyone else!
We have to do something to be heard and heard right!
Thats the beauty of this country you can reach out to people in the highest positions and get heard. When the voice is collective its even more powerful. Shyam along with many others met with many congressmen and senators over the span on 2 days to explain our plight to them. One congresswoman mentioned that when a bill comes to vote in congress she polls the number of phone calls and emails she gets from her constituency and submits her votes accordingly. I was surprised to see how much actually our voice means.
We don't realize the power we possess since we are sitting in our own life bubbles of work, home, stress, kids and everything that most often swallows our individuality and ability to think. We need to step up think for ourselves and and help ourselves and everyone else in the process.
Like Sheela murthy, one of the leading immigration lawyers, said that yesterday's rally and the forum immigrationvoice.org (https://mail.medimmune.com/exchweb/bin/redir.asp?URL=http://immigrationvoice.org/) may not make an immediate impact. But we are truly paving the way for the future of legal immigrants to the US.
The forum is the only organized and collective way to get out our frustration against the system! So many people don't understand the hardships and seriousness of the greencard issues. Especially the people who got their greencards pre 2001 era! If you are interested in finding out more about the forum and the need for high level lobbying please visit immigrationvoice.org (https://mail.medimmune.com/exchweb/bin/redir.asp?URL=http://immigrationvoice.org/). If you were ever stuck in the green card rut or you or you have family who are applying, please spread the word and join the fight!

The net result of this bill in its current state would be that Mr Bright wouldn't be found, he/she would be lost trying to maintain his status. As a fact America would no longer be competitive.
If you're really bright Microsoft, Oracle will still hire you.
I can tell you that if you have good communication skills getting hired here it's not a problem, in fact they won't even ask you if you're not a US citizen until the end.
I'm from a country in the Americas and I can say that most of the time there are limit for foreigners working in a company.
So its not unreasonable to put some limits.

To all EB3 members whose PD is current:
Monday is the last day. If you don't get your GC approved, you got to wait for at least 7/8 months before they start moving dates forward. Beginning of each fiscal year, the dates are generally very conservative.
And for ROW EB3, if the bill passes to eliminate country quota, you will be getting your GC in not less than 5 years from now which you could have get it if your f**ing attorney/company would have file it 7 days earlier! Big time screwed! I am one of them!
We are really missing the boat..till Oct'08 FY09 starts..:(
waiting continues....it became routine..

I feel moving VISA dates, EAD renewal and $$$ is linked.
By moving spillover till last quater..many (2007 filers**) are due for EAD renewal
If they had moved the dates, guys would have got GC and USCIS lose income from EAD and AP
** in particular EB2-I

Congratulations Dude !!! wow 6 years for a freakin LC.. What happened at the BEC.. did it go the BEC for BEC :)
By grace of Almighty, finally my Inbox received the email from USCIS that I was eagerly waiting for.
Just few minutes back, I received the Email from USCIS for myself, my wife and daughter saying "Current Status: Notice mailed welcoming the new permanent resident".
It's a long journey started in August 1997 with landing in Washington Dulles Airport. Got a chance to start the GC process by filing Labor in 2001. The labor approval didn't come until 2007.
In 2004 had to take a transfer to different company which caused me to start the Labor again in Nov 2004. Lost the valuable 3 years of PD date.
Finally the approval for 2nd labor came just right before 2007 July Fiasco. Luckily I had my attorney filed my application on July 2nd itself. And Rest you know the story.
All throughout I was on H1B, on permanent employment and never out of status. Never had any problem with Immigration process except for the GC delay. In any way it was an interesting journey, making new friends, had the chance to live in SFO, LA, New Jersey, Virginia and currently in Maryland.
Many thanks to IV and its members for providing the wonderful platform for sharing and collaborating for common cause.
I wish all the best to all those who are still in queue. Hang in there. Your turn will come.

Most of us are getting a one year EAD. Hope IV can act on this at least for EB3, as EB2 don't really care about the duration of the EAD anymore.
