We should NOT be surprised that there is no movement in EB2/EB3 Categories given the number of applications filed recently. We may not see any reasonable forward movement for a long time unless congress passes the visa recapture bill.
I don't think the July/August filings will have impact on the retrogression right away. The cut-off dates would retrogress based on number of applications ready for approval/approved pending VISA number. The applications (485) filed in July/August are not processed yet and hence will not impact retrogression today.

i guess desi3933's chart has 7 Day EMA, 14 Day EMA, & 40 Day EMA (on closing prices) on indicators (based on annotations on top of charts).
You need not stick to desi3933 strategy, get well-educated first about markets (equities, options, futures, forex) & indicators (MACD, EMAs, Sto etc) and do some paper trading/virtual trading - like vse.marketwatch.com - and then you would need to come up with your own strategy based on your level of risk, time you can invest etc.
Again based on desi3933's risk level, he chose futures - based on your risk level you may stick to ETFs SPY (S&P), SDS (inverse S&P), SSO (Double S&P) or options on these ETFs.

Please don't put any sensational heading on your post if you don't know what you are saying.
This has been discussed a lot here and is nothing new. There is always a possibility that USCIS can issue a mid-month VB and discontinue taking 485. It has not happened before, but is certainly possible.
If you thought, the dates will be current from here on to perpetuity...I have no words for you..

I am in the same boat. I see 4 or 5 people postings of this messages.
None one else this forum in this situation. Why not we gather how many of us are affected? Then it will be easier for us to plan and request our case to be included on IV agenda.

I don't know if there was a memo. I think AILA communicated this to the lawyers and I read it on Ron Gotcher's forum.
Apparently, the re-interpretation of laws were based on the changes in AC21, something they were ignoring till 2008.
Removal of country quota in EB catagories (if excess visa's available in any catagory, becuse of 7% impossition) was due to AC21 law. This was a result of hard effort by similar group like IV in 1998/99. DOS paid attention to this law only in 2007 (after 7 years). I think some lawyers/AILA brought this to DOS.

I did it for my wife and son, but thrugh an attorny, It costed me $375 total,
including the attorny fees. It is not required unless you leave the US.I had to do it to get an ID for my wife for DL purpose, as H4 approval notice was(I hope it is still) one of the accepted documents as 2nd id in VA.
Your wife may file for H4 without a lawyer. It costs $250 and I did it once. No issues at all, very simple and straight forward form / procedure.
Although not necessary to file H4 transfer )as this is not linked to employer directly but rather the H1 holder), it may become important when you leave US for visit home.

Your logic is not right. They are still American companies as they are based and incorporated in the US. Number of employees in India does not matter. It would be different if they had a majority of Indian employees in the US...

My I-140 was applied in Mar 2005, when my son was 20. PD became current in Jul 2007 and I-485 was filed. I-140 was approved in Oct 2007.

I am on OPT expiring soon.. My employer filed for H1 and got approved for oct 1st. I will be out of status for sometime so I plan to go on H4( I am married) . Now one lawyer told me that If I apply for H4 my H1 approval will become invalid and I will have to reapply for H1. i.e if I do not have I 94 attached to the approval ( however I just got approval notification . no documents received yet , so no way to know if i have I 94 attached) Another Lawyer said thats not the case. He said I can go on H4 with a validity till

BTW, today I treid calling USCIS. First the 1st level representative spoke and she straightway created a SR for me and my daughter. Once she finished that part Politely I asked her to transfer to an IO. Luckily without any wait call got connected to an IO. Had very brief conversation with him. He was fixated on my EAD being valid till August 2010, so according to him I don't have to worry about. But I persisted with my line of questions like current status, whether it is pre-adjudicated?, whether all clearances are done etc. Only thing he replied was "Your Case is in REVIEW". I asked him what does review means. His answer was review means review. Our conversation stopped there.
What do you guys think on "Your case is under review"?

I am in a similar situation. After failing to get a definite answer on the exact time taken by the process of changing status to H4 while in the US, I have decided to take a trip to India to get this stamped instead. I was told that change of status to H4 needs to be approved before starting school, simply showing proof of having applied for COS is insufficient. But if you apply for change of status to F1,then approval is not required before starting school. However I would suggest you confirm this from your lawyer/school.
