    USCIS does not differentiate US or Indian degrees.. Yes US degree has its own advantages... It more than just LEARNING...

    Education is a bigger word than learning... Institutions can impart learning only... You can be highly learned with big degrees... still not educated :-)

    Take a chill pill friends... Degree is important to USCIS like MPG (miles per gallon) to Car.. as its a basis to compare different entities :-)

    yeah 7 for EB3 total of 12 incl EB2, yeah there are a few June 07 EB3's in there. Mine is on July07 so i must be close :) ... fingers crossed

    E-Filed EAD on April 13th. Sent all the doc's to USCIS, Nebraska. No photo's sent. LUD shows April 21st (Initial Review). No FP yet.

    Your letter nor the proposed drft amendment to CSPA does not talk about the children of parents who applied their GC under employment based category and got stuck in the Labor Card approval stage for years and when labor got approved and I140 also got approved then again stuck due to Visa retrogression. We must include injustice being done to these children and should ask for retrospective amendment to CSPA to provide relief.

    If you are in Illinois are you near enough to try and meet with Richard Durbin, he professes to caring about the children of illegal immigrants. Maybe he needs to put a face to a situation of the forgotten children of legal employment based adjustees to push him into realizing they even exist and he does them an injustice with his DREAM act.

    I am a parent of an aged out child. It sucks, quite frankly. Never sure what to say to him when this issue is discussed. I would be happy to become more active on this issue.

    How many of us are on this site, does anyone know. Each of us trying to work individually is not going to be as effective as a joint effort.

    Is this happening this year too - TSC is giving approvals and not NSC? Last Aug / September when my priority date was current - it was the same, i know of people who got approved from TSC whose PD were 12/05.

    Also, it seems that all cases approved so far have an ND before 8/30/2007 so here goes again they will ignore PD and go by ND not even RD.

    after the jobs ads and waiting period (30 + 30 days) how long does it take for the perm approval to come thru. Can anyone who got their labour in perm update the complete sequence of process from start to end?? I appreciate their time in advance.

    After this waiting period, PERM was filed 9 days later KAPOON(approved)

    Hello Guys,
    For the next few months, we can either point finger at others (EB3 to EB2 and EB2 to EB1) or we can think through and come up with some solution for everyone. I don't know if pointing finger will help, but thinking and trying MIGHT. Do you guys think we should do that instead of looking at how guys are misusing EB1 ?

    not a bad idea. Only that those who came here on an F-1 will need to get an F4 (something like a dual-intent work visa) after graduation. those of us who came here on F-1 and worked hard for GREs and through grad school did it only because we wanted to settle down here.

    See, if you had immigrant intent, the F1 should have been denied. There should be no dual intent for any work visa whether F4 or H1 or L1, period. If the worker is supposed to be in a permanent job, only option should be to get a green card. The current system has encouraged a bad habit of pretending that permanent workers are really temporary workers who would eventually go back.

    Hi, Did somebody take advantage of the new rule of H1-H4 decoupling where one can use the time spent in H4 in H1? or can somebody confirm that this rule is in place and a law ? Please let me know.

    my wife worked for 31/2 years on H1/L1 before changing status to H4. After 4 years on H4, she recently got a job and he H1 was approved in 2 days under premium processing. So the decoupling rule is effective.

    Hi Folks,

    My PD got current at today's Visa Bulletin. Presently I live in SF City, California but we are in the process of move from California to Texas. We will be finally move to TX during Sept-2007. My questions are:

    1. Can we move from CA to TX after I-485/EAD/AP is filed from California?

    2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
    Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?

    3. What are RISKS of moving from state to state during I-485 process? Did anyone do that in this forum?

    Please advise - thanks

    If we are claiming to be best and the brightest having high skills and inventing then it is EB1 and EB2 mostly. By law EB3 is mostly for people who have Bachelor degree and hardly any experience in their field to claim as EB2. It does not matter you are masters from Harvard but by law, if your job requires just a bachelor degree then you are doing basic work at lower management. Legally EB3 have no case if they claim to be best and the brightest inventors. All doctors get EB2 or EB1. All managers with advanced degrees get EB2. All Scientists and PhD holders get EB1 and EB2. So EB3 is mostly people who are low skilled programmers or people who despite having higher degrees are doing jobs that do not need advanced skills. There are some exceptions of people who are screwed by their lawyers and employers by forcing them in EB3. These people should fight with their lawyers and employers or change their jobs to EB2. EB3 do not have a strong legal case to fight for EB3 if they claim to be best and the brightest. It is very humiliating but you like it or not EB3 is grouped with EB3 Other Workers that are waiters, janitors, construction workers, Farm workers etc.

    To all EB3 members whose PD is current:

    Monday is the last day. If you don't get your GC approved, you got to wait for at least 7/8 months before they start moving dates forward. Beginning of each fiscal year, the dates are generally very conservative.

    And for ROW EB3, if the bill passes to eliminate country quota, you will be getting your GC in not less than 5 years from now which you could have get it if your f**ing attorney/company would have file it 7 days earlier! Big time screwed! I am one of them!

    We are really missing the boat..till Oct'08 FY09 starts..:(

    I live in Los Angeles and sent my paper-based application to Nebraska. it reached on May 01 but no reciept or check cashed yet.
    I know After reading this forum that I should have mailed to Phoenix lockbox instead on Nebraska service center.

    Anyone in the same boat?. Do i need to file again or wait for USCIS to forward it to Phoenix lockbox.

    Just got card production ordered e-mail.

    PD - Dec 2004
    RD - Aug 2007
    ND - Oct 2007

    Never had any RFE. Centre - Texas.

    I am expecting 2004 EB will be cleared this month. All the 2004 guys just relax and be easy ( particularly SOP ). Honestly i didnt care much before, there are million things better than gc in life. Having said that, its good to have purely for travelling purposes.

    If anyone whose PD is earlier than mine, i truly apologize. Its not me, its USCIS. I have seen PDs same as mine getting approved 2 yr ago.

    Stay tight and believe in yourself NOT USCIS.

    Nirvana, Congrats, Did your case go thru TSC-EAC-TSC transfer? When is the exact ND?
