If a College fresh guy gets Rs 6,00,000 / yr at bangalore what will be the salary of a 10yr experienced developer 5 years down the line when the talents will move back ?
In fact I�m sure 10yr experienced can immediately mandate a salary of Rs 30,00,000 /yr at Bgl �. You will save almost the same that you are saving here.

Make sure your spouse has valid AP on hand while she travel to overseas...so that she return using AP at POE..so AP is must at this point as her AOS is still pending...
Also get advice from your lawyer in advance..
Thanks for your advice Webm...I will contact a lawyer as well. So what will be her visa status when she comes back to USA? Her H-4 is invalid now as I got my G.C. She has no EAD yet. Will she get into trouble assuming she travels with her AP?

;) you bet, here is the first draft.
illegal waiting at the border = 500 points handed in a platter when you cross the border. 100 additional points per day for 6 days after you cross 50 ft beyond the border.

Hi Gurus,
I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.

Do we need to have the original receipt notices.
I asked my attorney and he said that the copies would be fine.
He sent me scanned receipt notices via e-mail and says that it will
be fine and not ready to send the originals for some reason.
Can you guys think of any reason attorney not willing to give the original receipt notices?

In the 485 check list sent by my employer one of the item is :
"Affidavit of support duly notarized (Form I-864) if you are applying for your family"
I am applying for my self and my wife and for my daugher. I will send my all paper to my employer and he will sent to attorney.
Do i have to fill form I-864 or attorney will fill form. if i need to fill then where i can find this form and how i can notarize it.
Please help.

Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

I don't believe leaving the company that you had signed an I-9 form with have any impact on your GC app as long as you have a same or a similar job lined up if and when you do get an RFE regarding the same.
As mentioned several times, GC is for future employment and you can switch employers as many times as you want under AC21 (of course you don't want to go overboard with switching employers every few months either :)).
I hope this helps - again this is my understanding of the law and not a legal opinion.

Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

I-134 was the most confusing form for me too.
I let my lawyer fill it for me, and she did tick the "intend to" but did not fill the area in question.

Yes you would need a transit visa. In fact in Air India (not sure about other airlines) without transit visa you cannot even board the plane from US

The answer is Yes you can switch to new employer. Your H-1 does not matter anymore as you have applied for AOS and you have a valid EAD which you can use for AC21 portability for a new employer after 180 days.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

I would anticipate EAD to be processed in max of 3 months and AP in 2 months.
Would also add a buffer of 2 weeks (just in case).

I applied for I485 + I150 in June 2007 under EB3. My I-140 is still pending.
Employer used a preappr labor with PD of May 2005. However, the lawyer gave me only the ETA 750B portion of the labor to fill
Now, from some forum I found out that PERM was started in March 2006 and the form was 9089 to be used for labor after march 2005 filings.
So, how did my employer file my labor using ETA750B part which was applicable for old labors ?
