Hello,
My situation:
I have I-485 pending at NSC EB3 category with July 2007 filing date. My I-140 is approved. I am planing to quit my job and get a job in different job qualification.Hence cannot file AC21.
My wife got naturalized and after researching online, I made a decision to file new 485 with I-130,I-864 and I-131. My AP based on employment based 485 is expired and hence I applied for new I-131 through family based thus saving money.
I did not apply for I-765 (Family Based) as I had an active EAD untill 2012(Employment Based).
I am to quit my job and afraid that my I-140 (Approved Jan 2008) will be pulled and hence my I-485(Employment Based) will be denied/revoked. Since my active EAD is based on the employment based 485, it will be unusable/revoked as well.I do not want to invoke AC21. For this reason, I want to file EAD based on Family -I-485.
My question is :
1) Can I file for I-765 based on pending I-485 (Family Based IR1).
2) Since they required to submit the last EAD issued - which in my case is employment based EAD expiring in 2012, The chances are USCIS will deny it or am I to do something differently?
In brief,
How do I apply for 2nd EAD (Family based IR1 with new I485) while the Employment based EAD is still active?
What documents should I turn in ?
How do I explain USCIS about the situation?

The light never really got good this morning. There were too many clouds, and I couldn't get the light and shadow I wanted. Here's what I came up with. Let me know what I could have done to improve them. Thanks!

2. What is the safest & quickest way to get my h1 status active in system..
H1 STAMPING IN HOME CONTRY.
a) Stamping in Canada - Quickest for me. Is it safe ?
FIRST TIME H1B STAMPING NEEDS TO BE DONE IN HOME CONTRY, CHECK WITH ATTORNEY.
b) Get status changed without getting out of country? - But how?
THERE IS APPLICATION TO CHANGE STATUS FROM H4 TO H1, CHECK WITH ATTORNEY.
c) Stamping from Home country? -- Last option.
YES, YOU CAN DO ANY TIME.

Immigration experts,
Please help me to get out of this confusion.
My H4-H1 Adjustment of status is approved and i have Advance parole and EAD with me through my husbands i485 application.I need to travel to india in jan/feb 2008 for 2-3weeks.I may not be able to go for stamping at that time.My H4 visa stamp is valid till sep2008.My H1 approval notice is valid till sep2010.
My question is,can i travel to india and come back without H1 stamping using Advance parole? If i come in using Advance parole can i work again on H1 or do i need to use EAD?
Thanks in advance.

+1.
Whatever may be the outcome, it will be either better or lot better than current condition atleast in illegals case.

what does it mean? If you apply your 485 on July 2nd, within 6 months time (by Jan 2nd) you will get 485 approved?
This question has been asked 100000000 times..
your I-485 will be adjudicated in 6 months IF and ONLY IF your PD is current and your security checks are cleared. Without these 2 conditions, the processing times are pretty much useless for us.

I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?

Hi
I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.
Thanks in advance.

Good News for Our Citizenship clients. More than 9,000 candidates will become new citizens during 63 special ceremonies hosted by U.S. Citizenship and Immigration Services (USCIS) in recognition of Constitution Day and Citizenship Day on Sept. 17. As part of this celebration, USCIS is partnering with the National Park Service (NPS) to hold naturalization ceremonies at 22
national park sites across the country Sept. 13-24 under the theme, "Embrace Citizenship -
Experience America Through Your National Parks."
Highlights for this years celebration include a Sept. 15 ceremony for 25 new citizens at the
foot of General Grant's Tree, the largest giant sequoia in the General Grant Grove section of Sequoia-Kings Canyon National Park in Three Rivers, Calif. This grand park was named in
1867 after Ulysses S. Grant, the 18th president of the United States.
Other national parks ceremonies will also be held at the Grand Canyon, one of the countrys
oldest national parks; Homestead National Monument, which commemorates the Homestead
Act of 1862 granting free land to citizens and new immigrants; and the Herbert Hoover
National Historic Site in Iowa. The citizenship process (http://www.h1b.biz/lawyer-attorney-1131862.html) has been described as a ritual which is "meaningful for many immigrants" and similar in some respects to a "first communion" or "bar mitzvah".

Wrong forum iuiukk..This forum is only for LEGAL employment based immigration issues. You will not find a single soul here in IV that will help you or give advice to you to do anything illegal. We are law abiding professionals and so you are looking for advice in the wrong forum.
I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husbands citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husbands citizenship would be approved before that and I might never have to leave the US.
Thanks in advance.

from google I have 2 links. However both are contradictiing
http://www.immigration.com/perm/permdolnews.pdf
Completing Form ETA 750
AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.
Another one says its mandatory to fill
Can some share there knowledge?
thanks

Interesting (?!) situation!
One of my relative is on F1 visa, he wants to marry someone in India. He has applied family based GC. Can he bring that person in India thru a visitor visa here to USA and get married here ?
1. Is marriage between two non-immigrants valid in USA ? Can this marriage be registered here ?
2. Will his greencard process be in jeopardy if he gets married during the AOS wait time ?
Thanks
He can marry in USA..it is not dependent on any visa.. Just check state residency rules..
Her visitor visa depends on her situation and interview.
What category in family visa?
