I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.
I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .
If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

If its a new company, you need to do H1B transfer and start the GC from PERM. If the I-140 is not revoked, you can retain the PD.

Friends,
We are future permanent residents waiting in queue, for sure many of us are going to get GCs in few weeks/months/years. Considering this situation lawmakers can give us a chance to get the GC faster than waiting in the queue just by buying a house. But still they are searching for another solution than which could be effective.

Hi all,
I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..

My 140 (filed concurrently with 485) was approved on Aug 17th. Ever since 08/17 I have been seeing LUD's on it everyday. In fact there was a LUP on 08/19 Sunday! Any ideas what's happening? I think something is going in CIS.

I am on L2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job?
What is going to be his new status? If it is not L1, then your L2 status is gone as well.

It is very possible that my question might have already been answered in the past but after searching through many forums, I could not find a direct answer.
Here�s my situation:
Category: EB2
PERM approved.
I 140 approved.
PD � Dec 2007.
H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.
I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.
Questions:
1. Will I need a new H1-B? If so, for how many years will I get it?
2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

My H1B 6th Year expires August 2007 and need to apply for 7th year extension.
The below are options I read in murthy.com
1. Labor pending or approved before 365 days of H1B 6th Year expires
2. I140 Approved
Applied for PERM labor in April 2007 and still in pending status (First option ruled out)
After looking at July 2007 Visa Bulletin immediately Applied for I140 using Substitution Labor . Assuming that I can work on EAD.
And because of Revised Visa Bulletin I could not apply for I485.
Can I apply for 7th year extension based on I140 receipt (using Labor substitution)?
If no to the above question and suppose if my PERM labor is approved some time in July and if the USCIS start again the Premium for I140 Can I apply for another I140 from same employer?
Please reply ASAP,

Your MAVNI adjustment of status should cover your family, so they should be adjusting with you. You do not need to or have to send them to your home country.

Can anyone be kind enough to tell me how to talk to a real person at the Vermont Service center? It has been over a month since my employer received the receipt number from USCIS, but the case cannot be found online. I tried calling the number below, but the robot that talks says the same detais that I can find online.
"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

I worked with them for almost a year and ran like anything.
They were paying me meager salary even I had a good rate.
They started GC when I asked, which was good
There health insurance sucked
They reduced my salary at the last moment when I gave notice to my last employer. Agreed to give a raise after 6 monhts, never did. When I asked again after 1 year, they wanted to give me 2K raise which was nothing. This was after end client raised the rate by $5/hr
Owner/sales guy are amway, they'll ask you to go to there meetings. Somehow, i saved myself :)
When I left, they canceled my health insurance from a month back even when they have deducted premium from my salary.When I threatened to log a case with DOL then they gave the money (which they deducted) back. Still, I had to pay medical expense for that month (fortunetly it was less then the premium)

As a practical matter, you probably want to file your wife's I-485 application as soon as possible after the first day of the month in which your PD becomes current. As you know from experience, PD's can and do retrogress dramatically with little or no notice.
If your wife is in H4 status on the date that your GC is approve, she will automatically fall out of status. She can remain out of status for up to 180 days without losing eligibility to file for AOS, but if the PD retrogresses before she files, she has to wait and hope that your PD becomes current before 180 days have passed.
If your wife changes status to E-3 she can still file her I-485 when your PD becomes current. But,
E-3 status, unlike H-1 status, requires non-immigrant intent. So, theoretically, if your wife changes to E-3 status and then files the I-485 within 60 days, an allegation of immigration fraud could be made and possibly result in denial of her I-485.
