My interpretation is that that there is no appeal due to the fact she has applied early, she can apply again after the 90 day clock starts ticking and she should be good. If she gets a denial again I suggest using a lawyer, there are many on this site itself in the lawyers forum. But you seriously need to be talking about the specific type of the app if you need very precise answers because USCIS treats differnt apps well differently

My wife recently returned from India and at port of entry, the officer incorrectly wrote the paroled until date as Jul 12, 2010 instead of Jul 12, 2011. The date is incorrect on both I-94 and AP.
Will this create any issues and how can this be corrected? Her status is AOS pending, she doesn't have a EAD or H-visa
My wife's AP is valid till Oct 12, 2010. I would appreciate any help

Hello,
I'm a Jul 2nd filer at NSC and got my receipts on Aug 12 with a notice date of Aug 8th.I'm yet to receive my FP notice.

Use the AR 11 online process to change address do it seperately for yourself and your wife. When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.

You can be a passive partner (investor) in any startup (even without any visa). To be an active partner, you need to be a permanent resident or citizen in US. Here is a link for the details... YES
if so, will the priority date be same or it will be new once converted to F1 category.
IT WILL STAY THE SAME.
2. Can I apply for both family based and employment based in parallel?

I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

I assume u r returing US worker i.e means that ur just getting ur H1B extended in that case u can choose any consulate in your home country.i recently got stamped at New Delhi Embassy but my consulate is Mumbai.
Since I could not get dates for Mumbai consulate during my visit to India even though i paid my fees at HDFC mumbai branch. it should not matter as long as u pay your fees and u r a returning worker.

I live in NJ and my application was recieved on July 2nd. would that be Nebraska or Texas SC?
NJ comes under TSC but direct filing took effect only from July 30th. Till then the 485 was supposed to be sent to the center where 140 is filed or to NSC ( if no 140 filed). Even if it was sent to the wrong center USCIS will not reject the application in this timeframe. It will be internally transferred to the the correct service center.
