    Hi,

    I am in the process of moving between jobs. The old job is a teaching job in a university and the new one is a research position in a non-profit think tank. So there is no H1B quota issue for both jobs.

    The H1B for the old job won't expire unit next year. I have received the H1B for the new job. The start date for the new H1B is Sept. 1st.

    My question is: Can I start my new job before Sept. 1st? I understand that for H1B transfer, one can start the new job once the application receipt from USCIS is received. But in my case, I have already got the new H1B and the start date on that is Sept 1st.

    Hi,

    Need some help/advice on PERM LC issue:
    My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters or Bachelors with 5 Yrs experience),

    On may'09 got a query saying "Discrepency in Alien education and experience".
    Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.

    my emplyer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"

    my question: 1) Can this be considered as an error from the procesing center rather than my empr fault.
    2) How severe this would be and what ud be the turn-over-time.
    3) Do I need to reapply my PERM LC again.

    Another mistake (which I don't know if its from PERM ior my employer) is even though i have more than 10 yrs of experience the reason for denial as you can see above says "Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice."

    Another biased article designed to garner support for illegal immigration while trying to lull others into thinking that there is a crack down against illegals!!!

    169000 out of estimated 12 million is actually more than 100 times what you show it as 0.01%. It is close to 1.4%.

    Folks, here are some lobbying and action items that will be very useful.

    1) Try reaching out to your American friends/managers/colleagues and ask them to call Senators.

    2) Universities are missing in action here. They are major beneficiaries of high-skilled immigration, because graduate school is typical first step. They must be concerned with not only the fact that special categories for researchers/professors is gone but also that lot fewer students from India and China will labor in their labs. COUNCIL OF GRADUATE EDUCATION is a good place to start.

    3) Someone please write and op-ed piece of NY Times. They are pretty sympathetic to these kind of issues. A major criteria for publication in the op-ed section is that the topic should be current. The plight of legal immigrants can't get more current that this.     The op-ed should not be complaining in tone, but rather show the value of having a proper high-skilled immigration reform for the American economy.

    4) Where are those powerful desis we see on rediff? There are many desi executives, board members. They regularly dole out money to campaigns. If they can't put a word for us now, when will they do? After all most of them went through this process.

    These are only some ideas on how we can cause at least some ripples. Please contribute more and put some in to action.

    Hello All,
    I got my US green card in EB3-I category through consular processing after an interview in Montreal, Canada in 2004.
    My PD is 29 March 2002. My family could not accompany me to the interview and hence they did not get their green cards at that time. I wanted to schedule an interview for them since 2008 and the Montreal Consulate informed me that my PD is not current. This is somewhat strange as I have already got my Green card in 2004. I have tried all options but everyone tells me that I have to wait till my PD becomes current. I am not a US citizen yet. The way EB3-I is going it will be easily another year till my PD becomes current. (The PD date has moved by 1 month in the last 6 months)

    I will appreciate if anyone has any suggestions for me.

    Thank you frostrated and madmonkey for your responses. We had taken infopass and were able to speak to immigration officer too. That is where we were told there is nothing like linking or interfiling. I read the pearson memo multiple times but it says both dates must be current. EB2 is not current and hence do not know the validity of the claim. I will try infopass again and see before filing MTR.

    Dear Friends,


    My employer got an RFE in regards my recent filing of H1b.
    The RFE talks about the office space.
    Currently my employer has 3 employees and the available space is for 3 people. One of them is an Account Manager and basically the Manager has adopted the HOT DESK philosophy; so, basically the current work space is ok to accommodate me.

    When I went to my county health dept to get vaccination shots (for medical exam), they asked me to see the civil surgeon first, "else you will pay lot more for shots that you do not need". I gave them the standard list (MMR, Polio, DTaP, Influenza type B, Hepatitis B), and there are a few more in (page 3 of) I-693 form (http://www.uscis.gov/files/form/I-693.pdf). Someone on this thread (http://immigrationvoice.org/forum/showthread.php?t=5553) (second-last post) says you may need a shorter list based on your age group. Did anyone recently take these shots, and can she/he give the correct list here?

    If you file the extension before expiry of the current I-94, you will be OK. It can be approved even after the expiry. She will be considered to be legally present without gap, if extension is granted.

    Good afternoon all,

    I am very new to this world of immigration employment, and I am not sure what I need to do to assist an associate in finding employment and (ultimately residency) in the US. He is a friend of mine's father, and has been out of work in the Ukraine for the last 8 months; he is an electrical engineer by trade and has university degrees.

    From what I can gather, the Employ American Workers Act seems like it could be an impediment in obtaining a H-1B Visa (This is the type of Visa that he would need to work in the US, correct?)

    Can anyone provide any guidance or suggestions on how to begin the job seeking process, and potential obstacles to be aware of?

    Folks,

    The "Time as Resident in a USCIS District" clause in the naturalization process says that "Most people must live in the USCIS District or State in which they are applying for at least 3 months before applying".

    If you have gone thru this process could you please tell if this means that
    a. the person must have stayed for at least 3 months during any time during of the residency period to be eligible to apply in that district

    OR,

    b. the person must live in the district for at least 3 months immediately preceding the naturalization application (for example, if applying in July 2010 then must be present in that state/district at least since Apr 2010)

    The reason I'm asking is that I know people who live in India after GC and then come return to get citizenship...so wondering how it worked...

    HI Gurus,

    I need advice from you guys,

    My priority date is June 2005 (EB2) and my I-485 receipt date is July 7th 2007 at TSC

    My questions regarding Writ of Mandamus are
    1. Would I be qualified to file for Writ of Mandamus (WOM)?
    2. If I am qualified, would it be of any benefit for me to file WOM based on my criteria as
    detailed above?

    I applied for a green card for my wife just after we were married on May 11, 2009. We received an appointment for an interview in Detroit on August 25, 2009, but we had moved to Texas in the meantime. The appointment was rescheduled at the Dallas field centre on September 14, 2009 (Monday).

    I am wondering what to expect, from the small details to the big stuff. My 3 biggest questions:
    . Does anyone have enough experience to say if there is there reasonable parking available at the field centre? I have never been to Irving. The web page says that there is public parking available, but nothing about how much.
    . I was married before, and applied for a green card for my first wife. It was granted in 2004, and we divorced in 2006. Should I expect extra scrutiny / challenge because of this?
    . Is one actually asked questions of the "What sort of toothpaste does your wife use?" variety? I'm really bad at remembering these details, and am wondering if there's any curve ball that I should expect.
    . Is there a general impression of whether the Dallas field centre is a pleasant or an unpleasant place? My dealings with my first marriage (many years ago) were all with the Chicago field centre, which is very unpleasant, but my one piece of business with the Detroit field centre were easy and pleasant.

    Thanks so much to anyone who can help relieve my nervousness about what to expect.

    UPDATE: I forgot to ask another one: At my previous green card interview, the interviewer asked for a set of passport photos and paystubs for several previous months, although the interview letter had not requested them. I had been warned about this, so I had them with me. Naturally, I am also bringing passport photos and pay stubs this time, just in case. Is there anything else that I might be expected to bring that wouldn't have been mentioned on the interview letter?
