All,
1.Did anybody have recently got H1B stamping done in Hyderabad consultate.
2. Any issues with getting appointment dates.
3. I have all the documentation in place including pay stubs in the last 8 years.
4. Is it preferable to get stamping done in Canada than in Hyderabad,
5. How many days does it take to get the passport back.
Please share me your experiences,

I am planning to sponsor for my in-laws and have a list of all the required documents, but I have a question about the financial/property documents they need to to take. The reason being, my father-in-law is retired and since then they have been living based on he pension and rental from some of the properties they own and have not filed tax returns.
Will getting the property evaluation and showing cash balance sufficient OR do I need them to take any additional documentation. Their source of income is just the pension and rental properties. Since most of the transactions happen in CASH in India, they don't have bank statements or records to support the rental property, except for the original property documents associated with the rental properties.
Since I am the sponsor, I have got all the required docs from my side both immigration and financial docs properly. I believe, my in-laws also need to get the property and other docs handy to prove the ties back to the home country.
Please advice...

Dont count on it. There is very narrow chance. If you opt CP in 140, NVC will send your papers to consulate abroad, only after your PD become current. Consulate will take their own time to arrange the interview. It will take one month to six months after they recive your file from NVC. During that period the PD has to be always current. Consulate takes out visa numbers for CP, only after a successful interview. If your PD retrogress with in a month (like last year fiasco) consulate will not schudle a interview till it become current again. In that case your file will stuck for ever. Therefore, 485 is the best route. CP is the best route, only if the cutoff dates does not flutuate or retrogress back.

Hi,
My friend and his family got their GC's approved last week. They also have Canadian GC. My friend is the primary applicant and she is currently in US, but her husband is in India. He did not apply for an advance parole and was planning to re-enter the country using his Canadian GC. Now that his US GC is approved, will there be any issue at the port of entry?

I am on l2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job? you have EAD, that EAD was entirely based on your L2 status. If L2 status is gone so EAD is invalid too....

Hi,
I had a question about the H-1B cap. I am currently in F-1 status in
graduate school and am planning to finish my degree requirements
sometime in March/April 2007 and eventually need to be in H-1B status
to continue to work in the US.
I previously was in the H-1B status from Jan. 2001 till Sep. 2001 (9 months)
for which I was counted towards the FY2001 H-1B cap (more than 6 years ago).
In Sep. 2001, I switched to F-1 status to get a PhD and haven't been
outside the US for more than 4 weeks since then. My question is
will I be subject to the H-1B cap again, and get a new 6-year H-1B
term, if a for-profit employer files an H-1B petition for me for FY2008
?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and
not be counted against the H-1B cap ?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and

By the H-1B cap, I am referring to the numerical annual limit of 65k+20k.

Just a heads up about the new filing requirements for I-129s and I-140s. See link. In a nutshell all I-129s go to Vermont Service Center and all I-140s go to the Nebraska Service Center.

No need to pay taxes to India. I was grad student for 6 years and never paid a rupee to Indian tax authorities. Whoever got a letter from Indian IT for taxes on US income needs to see an Indian tax consultant.

I graduated in MS (I'm on H4 currently) recently.My previous degree is from India (passed out BCOM in 1999). I dont have any IT experience.
