Friends:

Two weeks ago I received an RFE for my E-Filed I-131 Advance Parole.
They requested two passport-style Photos but didn't mention where to send the RFE response.
However, on the top right-corner (next to the US Dept. Homeland security Logo) on the RFE page, there is an address (P.O Box 852381 Mesquite, Texas 75185-2381).

Underneath of the Director signature it has Officer # 159.

I'm really confused
1. Which address to send the RFE response?
2. Attention to what??? (Should I put Attn: to this officer # 159)



Please guide me ASAP...

I have received the following RFE.

Please submit the oldest available evidence which establishes your birth and parentage. This evidence may include, but is not limited to:

a. Hospital birth records which name the child and both parents.
b. Medical records which name the child and both parents.
c. School records which name the child and both parents.
d. Census records which name the child and both parents.
e. Religious records in the form of a certificate under the seal of the organization where the baptism, dedication, presentation or comparable rite occurred following the birth, showing the date and place of the child�s birth, the date of the religious ceremony, and the names of the child�s parents.

I have submitted Date of Birth Certificate at the time of applying 485 which is dated in 2002.

Ans:
I am planning to submit notarized affidavits from my father and mother.

SSC (10TH Certificate/Memo)

Are these enough? What are the other options ? Please let me know your valuable thoughts..

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following

1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.

How to get court deposition or evidence that no charge are filed against this arrest?

I have filed petition for expunging arrest record but that will take a while to conclude.

Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

Hi,

Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

In the last few days there is little news/action about STRIVE act. When this act was proposed all of us got excited and promised to each other to do everything to make it a success. Some of us did make phone calls to lawmakers (as per IV directions) but after that everything seems cooled down. Why are we losing our focus now?

Yes the new Senate bill S.1035 (tightening H1B program) might have put some doubts in our minds; but can we continue our efforts on STRIVE and deal with S.1035 thru amendments when it comes to discussion. Discussion about S.1035 on our forum is fine and in fact we might have to do that to figure out how bad/good it is our specific issues. But in the meantime we have to continue our efforts on STRIVE act too.

The next step was to schedule a meeting with our lawmakers. Many people are doing that. Did you try doing that?

In addition, today President Bush renewed call for immigration reform. Things will happen before the Summer break.

What is the last day for filling H1B? (assuming cap of 65,000 is not reached)

To be specific, can it be filled after 30th sept, 2009?

I am assuming you are talking about a new H1 that is subject to the 2009 - 2010 cap of 65K. You can file it anytime as long as H1 numbers are available. You can even file for a H1 in Sept. 2010 (that is subject to the 2009 - 2010 cap) if a visa number is available from the 2009 - 2010 quota (not sure if your job has to start before Oct. 2010 to qualify for a H1 subject to the 2009 - 2010 cap though).

In general, I see a lot of members quoting stuff that indicates shortage of tech workers and saying we should use them.

While this is true, it is worth understanding/appreciating the fact that most of these articles are aimed towards increasing H1 quota and not necessarily improving EB retrogression.

We should be a little careful which articles we use.

If she is out of the USA, what you could do is file a 'follow to join' petition with the US consulate in your country when your PD is current. You could file this if the marriage occurs before your GC is approved.

Gurus,

I am in a process of getting name change for my wife on pending I485. This is because her first name is given as 'FNU' by USCIS on the I485 file, EAD and A.P. As she did not have first name in passport.

We recently got her name change on passport by adding my(husbands name) as SURNAME. Now we want to refelect this change on EAD and 485.

For this amendment my lawyer is charging $400.
I want to know, if we can do this amendment on our own and avoid lawyer. Do any one on this forum know how to deal with this situation. Please let me know.

1. No - nothing about canadian PR is required, only country of citizenship

2. Nothing happens

3. I dont know what LOE is - already having a canadian PR doesnt affect 485 (we've done the same) - you cannot maintain PR of 2 countries at the same time

Today Immigration Customs and Enforcement ("ICE") (http://www.ice.gov/pi/nr/0909/090910elcentro.htm) announced an arrangement with Imperial County Sheriff's Department in which individuals during the booking process will have their biometric data checked with Department of Homeland Security ("DHS") data and FBI data to determine whether or not they are in the United States illegally. When a person's fingerprints match those of someone in DHS' biometric data system, ICE is automatically notified. ICE will then take steps to determine the individual's immigration status and then take appropriate action after the offender completes his or her prison term.

ICE already has agreements with Los Angeles County and San Diego County. Nationwide coverage is expected by 2013.

We need to make a very important decision this weekend and any help will be highly appreciated.

My husband�s (EB3/India) employer is willing to give us a �Labor Substitution/I-140� (PD: March 2005). But, I really want to apply for COS H4 to F1.

So the two options we have is
1) Apply for both �Labor Substitution/I-140� and COS H4-F1
2) Apply for COS H4-F1 and let go of �LC Sub�.

I have spoken to a lawyer and he is saying that we can apply for both �LC Sub� and COS and that there is a very good chance that COS will also go through, although there is a very small risk. But, I am getting conflicting messages from other sources suggesting there is a high risk of COS being denied.

We are trying to determine the amount of risk we are taking if we apply for "LC Sub" and COS at the same time. If the risk is high, that we would just apply for COS H4-F1.

This is a really tough decision and any advice would be greatly appreciated.
