But since your I-140 is filed, you should upgrade it to PREMIUM and try to get it approved asap.
Worst case scenario - if company B is not considered successor in interest to company A, you can still use the approved I-140 to carry over your PD.

Applicants for k-3 visas must apply at the US Consulate in the country where the marriage took place, or in their country of nationality. So, unless your marriage took place in canada, your husband will not be able to apply there for a K-3 visa.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

Hi,
I have been offered a job with a company who has an approved labor of Priority date Dec 2002. Seems like a good deal but I wanted to know if Labor Transfer is still possible. I mean Labor can be transfered from someone's name to mine.

It's H-1B season and the business immigration attorneys at Fong & Chun are busy once again fielding phone calls and inquiries regarding employment-based visas, including those of L-1 and new company visas. In the past few years, the USCIS and US Department of Labor have suspected newer and small companies of fraud, especially within the immigration system. Greetings,
My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.
My question is:
Will he be able to stay after his visa expiration date?
In other words, when will his I-94 expire?

Once your father enters the US, the expiry of the visa does not matter. Your father will be able to stay in the US till the expiry of the I-94.
The expiry of the I-94 will be determined by the officer at the port of entry. Usually, for parents, it is granted for 6 months, but there is no hard and fast rule and it totally depends on the officer who is stamping the I-94. However, I think for B-1, the max. duration is usually six months (again - not 100% sure about this - it could be longer too).

Are there instances where the processing time before interview will exceed to more than 3 mos? Is it also true that during the embassy interview, you are currently working? I am a nurse and my agency told me that I should still be practicing as a nurse during the time my packet 4 comes.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

Since you have Valid H1b, using H1b is better option. EAD � you need to renew it every year. If you are in EAD, then you have to have AP (if you want to travel abroad) which also you need to renew every year.
If anything goes wrong in your I485 (just in case) you will be in trouble, but that is not the case if you are in H1B. I am not saying EAD is bad, but comparatively Valid H1b is a better option.
If your previous employer won't revoke I140, then no issues, even revoking of approved I140 by your previous employer will not have any effect as you have completed 180 days after filing your I485.

keep in touch with me. i will try to go to local office after 90 days (ie after oct 2nd) in case i dont get EAD by then (my lawyer sent my 485 on 6.29.2007) . its just to expedite not for interim EAD. cause they dont issue interim EADs anymore.
but if you have decided to file for H1 then no point in waiting for another month.
in my case the lawyer takes too much money, even though i dont pay directly but it comes out of my salary, ultimately thats why i am not pushing for my H1 extension.
also i am hoping i will get my 140 by then so that i can get 3 yr extension.

Hi,
My friend is facing same type of issue. He entered the US with company A with visa expiring in Jul 2006.
In Nov. 2005 he moved to company B and his I-94 was extened till Oct. 2007 (New h1 expiry date). He went to India in Dec. 2006 and entered with old visa stamp. He got new I-94 with old date i.e. Jul 2006.
Now he wants to extend his H1 and I-94 is expired. Will this create any issue? Hase anybody faced this type of issue before? All replies will be appreciated.
