You can file uptill Sep30 2010, or when the quoto gets over, whatever happens first.
And as far as your start date is concerned, if your H1B is from the 2009-2010 quota and you've applied for it after oct 2009, it can start anytime after Oct2009 till Sep2010 ( the date your H1B gets approved), please get this confirmed though.

Thanks a bunch parablergh. 3months is a long time to get a replacement I797! I don't know if there is a shortcut to get the SSN by showing a notarized copy of the I797 that we have instead of waiting for the duplicate one from USCIS.

Thanks for doing this service which helps many ppl's lives.
My employer applied for H1 extn last year (sept'08) and after my project ended in Nov'08, I left to home country in Dec'08 (I-94 expired)and I recently came back on H4. I heardfrom my employer that I got an RFE asking client letter and due date was May 4th. He did not respond since I didn't have project. Now I am in the process of project confirmation, and I have to be on H1 to start working again,
1) Do I have to apply for new H1 (non-cap) or just apply for H4 to H1 COS or both? if 'both' then can I apply both in one package under PP? Can I start working on receiving receipt number?
2) Can I apply H1 with the same employer, will there be a problem since he did not respond to RFE before? or can I apply for H1 transfer to a different employer using the previous H1 receipt number(is the receipt number still valid) or apply for new non-cap H1?

i am switching employers and i have about 10k in my 401k with current employer. my next employer does not have the option to start 401k until after one year of service.i am looking for options to rollover my 401k to a IRA in a company. does anyone have any recommendations?thanks in advance
I still have my 401K from my old job that I quit about 3 yrs back into the same (company's) account. The reason I didn't roll them into IRA is that I prob would have made the same selection of mutual funds that I currently have in my 401K. The company is stable so no worries there. Point is, move your money only if you think it will serve you a better purpose or else wait for your new 401K to kick in and after that just roll over the other account directly into the new one...
Just my 2 cents, of course...

My husband is in the same position too.He is a fellow and got a job to start in 2008 july.lc dne.i 140 pending..
Can he file for i 485....ead for a future job...this has been in our head since this evening....cant wait till tomorrow morning to ask the lawyer:rolleyes:

There are two phases to this fight. The first phase has less to do with us and more to do with waiting for the dust to settle. We have to wait till the end of the elections for getting a clear perspective of what our approach should be. It looks like the lame duck session will be short and we will be very lucky to have anything done.
The second phase is to start contacting congress men after the elections and push the momentum to have something passed.
In the meantime we have to keep creating more awareness among people about this problem. It requires patience and you have to keep frustration and negativity out. As you can see there are plenty of people who are ready to spew negativity at the slightest provocation. The way I see it, we do not have an option to fall to negative sentiments. We have to fight this out no matter what the odds.

In my experience in such matters, it is really not helpful to post qualifications and ask for chances of success. You need to discuss everything with an immigration lawyer since it is a highly difficult catagory for anyone. There are several finer details in each of the criterias that regular members do not know on forums.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.
