You can live in US legally beyound your current H1B I-94.
As long as your AOS (I-485) is Pending, Ofcoure u need EAD for work.

I have utilized AC-21 and moved onto another employer and I will be using my EAD. I have an I-94, from the I-797 of my previous employer, which expires in May 2008.
The question I have is if we have utilized AC-21 can we still live here in US past the I-94 date? Will the stay be considered legal? I ask because as far as I know when a person is on H1B he can not afford to go past the I-94 validity date, does the same apply with an AOS applicant?

I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?

Thanks for reply. If I-94 issued for 1 year, suppose we change home address from one state to another state, until what time the driver's license will be issued(most of the states check the I-94 validity end date)? will it be only 1year till the I-94 expires? If yes, what is the process of renewing the driver's license after one year.

yes, they are right. if you try to file GC now then they will calculate your stay period and ask you to leave the country immediately (they wont even wait for july 2011). I think it makes sense to go out of country asap for one full year, come back with new H1 and then start the GC process. Alternatively if ur spouse is working and is on valid status then convert to H4. you can start ur GC process on H4 too. Once labor is approved activate your H1 and file for 7th-8th year extension.

Please note that an I-485 approval invalidates the H-1B visa.
I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

Thanks so much for your help. I had a question for my friend. He is on H1B status with wife on H4 status. Both expiring Sept 30 2008 (First three years). They applied for regular extension in July 2008 (for both his H1B extension and her H4 extension). Application is pending. Question is will her H4 status be affected if she leaves the country before approval of her extension? Lets say she leaves the country in October 2008 before their extension is approved would that cause any problems? She would plan to come back mainly once his extension is approved as she would need to take his approval in any case to Mumbai Consulate for H4 stamping. But the question is would her leaving the country cause any problems? and can she just use his approval once it comes to get her H4 visa stamped and then come back? My I-140 was approved in EB2 with company B from TSC with PD:01/26/2004 and I-140 pending in EB2 with RFE in the present company A. I do not know at this point when it will be cleared. BTW receipt no# is with EAC. Does it mean it went to NSC for processing? It is high time for me to shift to company B on H1 transfer as per our understanding. Presently I am on 7th year extension and left with 2 months for 8th year ext.
Questions:
(1) Can I transfer to company B based on recent I-140 approval and get 3 year extension?
(2)If I have to get 3 year ext. I have to wait until I-140 is cleared from present company and then got for 3 year ext. then transfer to company B. But I guess it will be long wait and no one know what happens until the RFE is get okayed and I-140 will be approved. So my choice here is very limited in that aspect.
Crux of the problem is that I have better opportunities out side the present company and running short of time to make a firm decision to tell the present employer that I am looking out side which is very sensitive issue to handle on all other aspects.

My dad just scanned my BC and e-mailed it and I took a print out of that and sent it for the I-485. (No RFE)
Why do you need the originals ? There is no requirement to get it notarized as well.

look at the vfs website (you will get a link to it from consulate website). They have specified some particular HDFC branches in metros, where you can deposit the fee to get the receipt.

Hi All,
My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?
