    Hi friends,
    I need your help!!!

    I'm here at California with L-2 visa. I can stay legally in US but i can not get a SSN number, i can work too.But For a driver license they ask for SSN. Do i still get the Driver License or no?

    If you have valid L-2 status, you need to apply for your EAD (file I-765 with USCIS) to be able to work legally. Once your I-765 is approved, you will get your EAD card and you will have to take it to your local SSN office and apply for a SSN. Having your EAD (employment authorization) card allows you to apply for a SSN. Also no matter what, you will need a SSN to work legally.

    Hi All,

    Employer A - original sponsoring employer. Got laidoff and joined B (large corporate). Before dates got current got offer from C and C applied for H1 transfer. Now received RFE on I-485 to provide EVL from current employer along with paystubs and W2.

    My problem here is that I consulted Murthy and they are saying that I need to make a choice between my current employer B and my potential new employer C whom I have not started working yet but they have filed for H-1 transfer. If I respond to the RFE using my current employer information then it is more straightforward but then I will need to stay with them if I get my GC right away after responding to the RFE. But if I use my new employer's letter then I don't have paystubs to show until I join them which won't be until the H-1 transfer goes through and I go through one payroll cycle. But that will be too late to respond to the RFE.


    If I don't join C then I need to pay for the H1 transfer that they filed and attorneys fees. At the same time I am also not happy with my current employers HR and attorney.

    Country-wise caps are clearly not a sensible way to retain the best talent in the world in the US. The purpose of the EB visa program is to get the best contributors to the US economy mostly when and where Americans are not available. The EB immigration system is not a socialist entitlement program for prospective immigrants from China, India or the ROW. The program must be fair to the US, fairness (or lack thereof) to all qualified prospective immigrants is a consequence not the intent of the law.

    The sad truth is that, no matter how sensible that argument is - a large section of people will not understand that or will choose to distort it out of fears such as losing their perceived entitlement - simply put many will simply refuse to buy it. Therefore, if we wish to pursue this issue we need a middle ground proposal.

    Here's an amendment that strikes middle ground ......

    For a given year, to estimate the demand, first calculate from the last three years data, the average number (percentage) of visas charged to each country under EB1, 2 & 3. For any country that was charged more than an average of 7% of the visas in the last three years, limit the visa allocation in the first quarter to 7%. In the second and third quarters, limit the allocation to the actual average percentage for the last three years. In the last quarter, remove all such country-wise limits to ensure maximum usage.

    I'm no legislative expert, but after reading the text of the law at http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=cb90c19a50729fb47fb0686648558 dbe (chapter 1 - Selection System) , it is my understanding that the law already permits something very close what i have proposed. It is up to the executive branch to change their policy here - this seems like a classic case for an Executive Order.
    Any thoughts / comments?

    I have to confess error and make a correction. The AC21 legislation changed things far more that I suspected and changed the allocation process from what I had learned previously. In further corresondence with the Visa Office, I've learned that I was wrong about how numbers are moved from worldwide to single state allocations. The following is a direct quote:

But those extra numbers would need to be made available to China/India applicants on an equal basis, and in doing so making sure that the additional number use would not result in the Worldwide annual limit being exceeded.     So whatever said in the visa bulletin makes sense.

    Who still thinks this is a normal depression? I feel like saying "I told you so".

    Noway it is normal..
    When was the last "normal" economic cycle when so many big banks failed...

    Lehman Brothers were 150 years old bank meaning they say great depression and the world wars and survived all of that.. This time it disappeared one morning.

    Citi, BofA,Wells etc are all in trouble..
    Would you believe Citi stock at 3 Bucks?

    And it all started with Housing.

    House prices never go down! Oh yeah.

    Guys... little fruits are like ration in a big march. .... that is VISA recapture etc...

    Spill over,... Simimilar job etc are low hanging fruits..... we must try to pick them ....else we wont have the energy and momentum to go for a VERRRY LONG march ahead of US...

    Good leaders do not lead a tired and hungry force...

    I have already started sending letters to Napaleto at USCIS...

    Guys just send letters with a CUT PASTE of the rule....

    Well ... that's the sad part. Everyone in core team is probably reading this but no significant feedback or suggestion has come from them. May be they are all too busy or this topic doesn't have any merit or has been discussed in depth already before. I am not sure what's going on.

    Unless you have clearly written promise that they will apply for GC, you cannot fight in court. Secondly, even if they did give you in writing, there is no time limit on when they can file.....they can effectively file labor a month before 6th year of H1 and have you out of status and therefore layed off.

    In that case, employers should mention the following in the offer letter

    " In case, in future, if economy goes bad and recession occurs,we cannot sponsor your green card since it is easy to find american citizens who has minimum qualification."

    This should be mentioned on the offer letters given by big comapnies.Then it is up to H1B candidate whenter to take the offer(risk) or not.
    Can these companies do this????

    Hi,

    I called USCIS today, i was asked to take infopass to get a status update on my case, as it was pending in local office. I am not sure why.

    My PD is 2001 March, from Dallas BEC - LC cleared on June 2007. Filed 140+485 on July 2. In my company atleast 400 - 500 number of EB2 cases came thru in June 2007, there were a few hundred lcs from BEC for EB3 too..from 2000-2001 time frame, based on some of the threads I have seen. We are one of the largest networking company in San Jose, here. I am sure there are other companoies that have good number of folks, also depends on how many stuck on..
    Filed my 10 th year H1 extension,
    PD March 2001
    EB2 - Category - Adv Degree
    Country - India
    Degree - Research IIT/IISc Bangalore.

    Following advice of 'Googler' i skimmed through the USCIS OMbud's report. So USCIS is not able to accurately 'count' the cases because old cases at local offices are not accounted in system (?) . Otherwise it would have been a quick data base query to obtain whatever statistics.

    And i was interested in knowing how many India EB2 pending till Oct.2002 ;-)

    I think this is pure ignorence on part of the reporter. Most Americans are not aware of either H1 or GC all they know is legal & Illegal immigrant. they dont understand the finer details of the system.

    EB3 India is in the year 2002. For the applicaiton process, the Perm certifications expire if there is no I-140 filed with a speculated amount of time, I think it is 90 days. For EB3 I with a 2010 priority date now, how does this system justify filing I-485 so many years down the line, when the PERM certification itself was validated so many years back. This process just doesn't make any sense.

    I hope not. If they ban bodyshops the cap will never run out.
    And people in Real companies will be able to get the visas.

    Some of the US Companies, listed in NASDAQ / NYSE also provide human resource to Fortune 50 companies and they follow the LAW as requried. I do not think the provision that would prohibit employers from hiring H-1B workers and then outsourcing them to other businesses would be in this the bill, Atleast these businesses will lobby to take it out.

    issue one year EAD and milk more money

    First thing came to mind, almost everyone gets 1 year EAD. Perhaps it is not easy to decide who gets 2 years EAD. This movement of dates solves the problem.
    .. Most of EB2 gets 1 yr. EAD
    .. Most of EB3 gets 2 yr. EAD

    Not to be a damper but I think theres something else thats going on and its not for the benefit of EB2. I know many people before April 04 who have not got their GC's. Anyways, lets hope for the best.
