As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

The doctor will give you two reports. One open envelope for your records and Another sealed envelope for USCIS.
You should not open the Sealed envelope and this sealed envelope should be submitted as is when you are applying for your 485.

I agree that house appreciates on average at inflation + 1% but it is still not a bad investment because most likely everyone would be taking a mortgage. So what we need to find out is a equity return on house?
For a 30 year mortgage and a 20% down payment, the house return on your invested equity of 20% by the end of 15 years is approximately equal to long term stock market return of 10%, even though the house is appreciating at inflation + 1%. This is because of deleveraging.
However, if we do not refinance by the end of 15 years then the house becomes a bad investment and the returns go down.
I beg to differ. House is a BAD investment. Historically houses appreciate approximately at the rate of inflation+1 or 2 % points.(Forget bubble years). Plus the costs(maintenance and property taxes) related to house ownership makes it a really BAD investment. Imagine putting money in an account which gives 2% returns and has 2% maintenance charges!

THere was a nice description of teh whole process in some earlier thread: they get visa numbers in chunks from DOS. They ask for them as they need them, and there is also some per-month, per-quarter rationing that goes on. Based on that they pick up and approve applications and keep using up visa numbers. They are supposed to pick up applications in order of PD, but do so in a mix of PD/RD. When they get to an applicant who is otherwise approved but they are out of visa numbers for this month, they pick the following 1st, 8th, 15th or 22nd as the cutoff date.
Dates are most likely not moving because:
- they have reassigned everyone to do receipting (as they mentioned in their FAQ)
- some dates in current VB (esp for EB3) have been pushed so far back, that they probably dont have readily approvable applications (preadjudicated)
- they are waiting for a complete tally of July VB filings to get an idea of how to move the dates

Sorry to hear about your aging out issue. I think there are more out there than anyone realizes.
My son aged out while I was waiting for labor cert clearance too. He is now 22 and has been in the US since was 14.
I hope and pray every day there will be some relief for our families.
Every now and then another case pops up here on immigration voice and I feel it entirely appropriate that this issue is put in with the aims of the group since it is a problem entirely created by the broken employment based immigration process.
Please listen to our voices core group and do not forget us. We are in the same queue as you all whose children benefit as derivative green card applicants, our children are just a little older when they came here and have become forgotten victims.

I would suggest you file asap on June 1st at least by June 15th. Dates are going to retrogess - this is what my lawyer told me.
You can file anytime between June 1, 2007 and June 29, 2007 (June 30 is a Saturday) assuming the dates retrogress in the July visa bulletin. I will be surprised that the dates will retrogress in a month simply because all the people filling for 485 will not be necessarily counted towards 2007 quota.
The trick is to know the number of people who are already in 485 and simply waiting for adjudication.

As a Congresswoman and the chair of Immig subcmt she is investigating irregularities and wrongdoings at the federal govt. She also probably thinks immigrants have been treated unfairly.
We shouldn't make her the target of anti-immigrationists; could hurt her, and hurt us.

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.
I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

Today I have contacted Ron Gotcher and here is his response.
1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.
1. Rather than every one sending separate letter, let us send only one letter and every one signed that.
2. Let us create one yahoo group, send all your infomation, Name and adress.
3. Draft a letter to OIG, attach all our information.
4. Based on the response let us decide our next move.

I have told them that Im the only bread earner of the family and the cost of living in the area that i live is very high and that I have bills to pay. But they have denied my request. i dont know what other financial hardship should I show them. Maybe I should declare bankruptcy and then send that over to USCIS to show that I really have financial hardship.

for your kind words about my response. truth of the matter is, i was pretty upset and seething in anger for a good part of saturday. finally i decided it was better to "lose" this contact for good, than put up with the outright insult. we have nothing to be afraid, ashamed or apologetic about our cause.
thanks again for your kind words. i did get a positive reply from a dean at my alma mater, a leading pvt university, that fully supports these positions. possibly an indication that we should be reaching out to US university deans to get their active support?

Nice post, i came to the US in 1996 for my masters, followed all rules to the T and got stuck. I am on my 4th AP and EAD (5th if you consider OPT). I think main problem is that we are trying to solve too many issues with limited ammunition. Start with a single point agenda for the short term...lets say recaptuing unused visas or something that is the least controvertial and focus on pushing it at every available opportunity. Currently we see a new proposal everyday and all they do besides encouraging debate (which is good) is motivate bystanders to distort the issue and divide the group.

The outcome of it does not matter right now, atleast the process has started and we need to follow on it with some targeted activity. Lot of my fellow IV'ians gave suggestions and some presented stories too. I did come across this thread only today and I missed out on an opportunity to present my story but nevertheless others have done so, i am somewhat lucky that despite the pain and hardship I did get my GC a year and half ago but I feel the pain my friends go through every day and continue to associate with IV.
I have read through each and every post made in this thread and these are good responses. There are some very good proposals - some likely to benefit a small set of
people ( GC's for Master's from US universities) and others wide encompassing.
I think the fix for this needs to go beyond smaller subsets of people.
A single master stroke is not going to erase the backlog it will need a series of fixes and the best way to go about it is to push for 1 or 2 main goals which will eliminate most of the issues. IV's core efforts are in the right direction.
IV'ians need to be united in getting a broadly accepted solution to majority of people rather than a small minority. Clearly my allegiance lies with people with priority dates which are more than 5 years old, people who are stuck in backlog centers, name check's and unexplained delays for no fault of theirs. This is not to belittle other people who are in the line for their GC's everybody have to wait their turn.
Friends who are espousing the cause of faster GC's for US Masters, do not sit on the high pedestal and belittle the people who came in on 'work visas'. They have as much right as you to have that 'Green card'. The time is not to fight EB2 vs EB3 or by ethnicity. A big deluge starts with a small drop of water, let us begin somewhere and once we get a fix to the larger problem other things will fall in place.
oh for the people who are ready to bash me, please see my profile, been in this country since 1996 and earned 2 Masters and yet classified as EB3 by employer. Yes I joined IV late officially but I try to do my bit in whatever way I can.

I did come across this thread only today and I missed out on an opportunity to present my story but nevertheless others have done so, i am somewhat lucky that despite the pain and hardship I did get my GC a year and half ago but I feel the pain my friends go through every day and continue to associate with IV.
I have read through each and every post made in this thread and these are good responses. There are some very good proposals - some likely to benefit a small set of
people ( GC's for Master's from US universities) and others wide encompassing.
I think the fix for this needs to go beyond smaller subsets of people.
A single master stroke is not going to erase the backlog it will need a series of fixes and the best way to go about it is to push for 1 or 2 main goals which will eliminate most of the issues. IV's core efforts are in the right direction.
IV'ians need to be united in getting a broadly accepted solution to majority of people rather than a small minority. Clearly my allegiance lies with people with priority dates which are more than 5 years old, people who are stuck in backlog centers, name check's and unexplained delays for no fault of theirs. This is not to belittle other people who are in the line for their GC's everybody have to wait their turn.
Friends who are espousing the cause of faster GC's for US Masters, do not sit on the high pedestal and belittle the people who came in on 'work visas'. They have as much right as you to have that 'Green card'. The time is not to fight EB2 vs EB3 or by ethnicity. A big deluge starts with a small drop of water, let us begin somewhere and once we get a fix to the larger problem other things will fall in place.
oh for the people who are ready to bash me, please see my profile, been in this country since 1996 and earned 2 Masters and yet classified as EB3 by employer. Yes I joined IV late officially but I try to do my bit in whatever way I can.

i fully support eb3 becoz their backlog and pain is more severe...... but fragmenting everyone in smaller groups..... like eb3 v/s eb2 v/s eb1 will not fix any problem...... i think there are anti-immigrants or people from other tracker websites who create fake ids to make people to fight with each other..... look at this eb2_unite guy..... she/he created his id today and is suggesting creating a new group of eb2...... i know for certain ..... 1000% certain that he will not do anything about creating a group...... he is writing inflammatory posts so that people here are divided and continue to talk rubbish......
this a$$ (eb2_unite) and other like him should be collectively shunned by everyone...... we are all educated and we should use our brain.... at least sometimes..... to see beyond the obvious when some a$$ writes inflammatory posts......

Thanks for your post and the "dignified" language of your criticism. In a public forum it is impossible to expect everyone to talk in the same voice. Dissent in inevitable. If you are a staunch supporter of the EB3 cause, it is your prerogative, but you cannot expect every EB2 person to fall in line with your thoughts and call them traitors. Is it a sin for EB2 people to join together and protect their interests and represent their case? Is it not democratic? What way is it inflammatory or legally wrong? I am only asking those EB2 people who feel that they would be affected to ponder over the impact of a re-interpretation. There is a legal avenue to port from EB3 to EB2. Eligible EB3 folks can certainly port to EB2 and get benefited.
A few EB2 and EB3 folks have spoken logically about working unitedly towards visa recapture. No one seems to listen. I am willing and keen to support the visa reacpture. That is a positive approach. However, if reinterpretation is the only route EB3 friends are interested in, then EB2 folks will have to rethink on their approach to the issue. Like it or not, that is the reality.
