Hi Mayra75, Yes this is a bad situation for immigrants. Hope it will be resolved in 2006. If you dont have any other option, you can look for a job in a University or a Non-profit organization which does not come under the cap.

Came to US in 2004. But never was after GC. Applied in Feb 2008 EB2. So does not look like will get my GC in next couple of years.
'cooler' has well said that value of GC has changed as life has progressed. Now thinking of going back as parents getting older. Plus daughter has US citizenship. If she wants to come back here, that is her privilege.
Completing 40 SS credits next year. So can return after that. Bought home in 2006 at the peak of the buble so getting out of the house is probably the only hurdle left.

You can consult any lawyer. To the best of my knowledge you dont need employer sponsorship if ur a PhD although i could be wrong.

USCIS will have no way of knowing whether someone is collecting Unemployment benefits. At the time of I-485 approval, they may need your EVL to prove your employment if you have used AC21. As long as you can provide that letter, you should be safe whether you collect Unemployment benefit or not.

1. Is it advisable to file amendment I-824 or other (requesting an amended approval notice with retention of earlier priority date) instead of filing a new EB2 I-140 once EB2 Labor will get clear? My 485 is pending with EB3 I-140, where as EB-3 I-140 got approved before filing I-485 in July'2007.

Yes, I think this is absolutely true - infact, I have given myself till 2007 end for that specific reason. If nothing changes by 2007 June/July, I will start looking at Australia, Canada, UK and India (most likely I will go back to India).
I might come back when this country changes, and believe me, it will change, esp. when people from baby-boomer generation retires.

AFAIK, oneway ticket originating US can't be bought in India. You need to cancel ticket, and buy a return (both way) ticket.
Usually tickets bought in India is cheaper - so there are these restrictions.
It is possible to buy a ticket from US for a journey originationg from India. Airlines passes instruction and Tickets are issues in India.
Rules might have changed, but this was latest information from my side.

Based on my limited knowledge and what I have read...you can join some community college during that time to do some short course in order for you to NOT GO OUT Of STATUS and this acts as a bridge. I think during this short course period you would have to go back to F1 and then convert from F1 to H1. The other thing is to go out of the country and re-enter again on H1. These are the only two options coming to my mind. But wait the third and more realistic option would be to find a position in any University related to your profession as then you are out of H1b quota. Good luck and warm regards

The link says all the majors considered as STEM. If you choose Browse by STEM discipline - those are the STEM disciplines..
Read carefully. It states that those are the occupations that might require a degree from those STEM Disciplines. For e.g. If you see under Life Sciences, it states that Farmers might require a degree in Life Sciences.

You will retain your PD.
If your employer recalls the 140 it could casue potential disruptions. If you have an EAD, just port your employment to some other employer. That way you will be dealing with less hassles.
I haven't file 485 and have no EAD.
Just an approved 140 with looming layoffs.

One time IO entered my visa type wrongly. Instead of L1-b he wrote H1-b on the I-94. I pointed out his mistake saying "My visa is L1-b. Shouldn't that be L1-b on I-94". He asked me "what visa are you in?". I repeated L1-b. He was angry and said in a raised voice "You should know what visa are you in. You should know". First place he didn't ask me what visa I was in and he made the mistake and jumped on me.
Baseline is IO can make mistakes but we are the one to be affected by that. So make sure your visa type, EAC #, and all other info on I-94 are correct before leaving the counter at POE.

Lawyers havent received notice yet either...does CSC only enter receipt dates or do they process EAD, AP etc. as well prior to transfers?
CSC will transfer the 485 to other service center (TSC, etc..) if you do not belong to their jurisdiction, but will process your EAD/AP, if they do the data entry. My 485 is transfered to TSC and got the transfer notice, but they also processed the EAD/AP. Received the EAD/AP from CSC.

While leaving India is there any place we can declare saying this gold we are taking out of india.

We can send these to Nancy Pelosi & Harry Reid. I am in. However it will only be effective if we manage PR well. The only reason flower campaign worked so well was because it was all over in the news. So I guess we should either copy some reporters (which I think may be too much data for them to appreciate) or make a press release through IV.

So, what is the difference between filing MTR and re-filing after it is declined? Why can't everybody whose h-1 petition has been declined, re-file for H-1 rather than going through the tedious path of MTR?
