Yes but I was thinking, spouse and children are counted in family based visas and how exempting them will benefit EB visas. Correct me if I'm wrong. :confused:
At present the dependents are counted in the EB cap...So the number 140K for EB is principal applicant+dependents combined...This bill exclude all dependents of EB from any cap...(But the country limits still apply I guess)...

IF labor approves, do labor dept informs employer only or they also inform candidate?

Hi
my wife has got H1 this year and
she wants to transfer to H4 as she got Ead and she
wants to use EAD .and still we didnt get AP.she wants
to leave to india in jan she dont have stamp in her
passport
if we apply now for the conversion of H1 to H4 can
she leave to india now and can i send that approval
letter to india then she goes to stamping in india.
is it possible. please suggest me
She can stay as "Pending AOS" and work on EAD. If you are worried about
keeping H status also. You can keep ur H1 if your primary. If anything happens bad with your GC , she can go out and come back on H4. Just switch her to EAD , get a job.

Did we ever think about forming a team with other like minded people under one banner? I think we will be able to effect something if all Pro CIR people join hands together and pool our resources. Any suggestions??

AILA sees 11 milllion clients at their door step, so they support more of CIR which mostly favours illegals
Compete America is more towards corporate interest, they will be happy if they get more H1Bs, they do support more EB green cards, but I don't think itz their top agenda
IV is formed by guys who are really victims, so we know whatz in our best intrest, none of other groups are not victims they just want to take advantage of current situation
never the less their policy do align with ours , so I am sure IV core members are in touch with these organization and work them more closly

Hi all,
I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

so once your processing date is current, then no matter what (if your pd is current or not) they will start the Name Check process or will they wait until my PD is current to get started on the Name check process.

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

If you were a student on F1, and if you just got an OPT (Employment Authorization), you do not have to pay Social Security tax. Once you switch to H1, you have to pay the SS tax.

Hello can anyone tell me the procedure to file I-539. I overlooked my wife's H4 visa (assumed visa will be renewed when i get my H1 renewed at consulate). I am looking for information to file for I-539
Also My wife's visa expires on Dec 9th 2007 (I94 expires on Dec 20th 2007). Is it possible for my wife to stay beyond Dec 20th if i dont receive the H4 renewal by that date. I am planning to file I-539 by Nov 8th 2007
