Hi there,
I am from northern NY, close to the border and my spouse has been to Ottawa twice for H1 renewal.
No there is no problem at the actual border. However if you are driving through the Adirondacks be prepared for Border Police (best not to drive at night). Also there has been a lot of snow and the roads are very slippery (the region gets some serious snow and wind chill). Make sure that your car breaks, tires and heating is okay.
Drive safe and Best of luck!!!

Post MBA (since Jun'06), I am working with a new employer. My previous employer (bachelor degree), filed for my labor in Nov'04 and I left this company in Jun'06; howevr employer didn't withdrew my labor application. My labor with previous employer was approved in Feb'07. I have good relation with my previous employer and they are ready to file my I-140; I have few questions regarding this:
Can my previous employer file I-140, even if I am not working with them?

If I-140 is approved, would I able to transfer the PD to my new employer, when he initiates my labor application.

Once I transfer my PD, can my previous employer use this approved LC for other candidate?

For the 140 appln we see that all service centers except TSC takes more than 6 months. TSC has a processing time frame of 6 months for 140
where as NSC and CSC says they are processing 140 of Sep/jan 2006.
We pay same fee for USCIS at all offices. This is a descrimination based on
USCIS location. If 140 is approved and 485 is pending we have flexibility of changing the jobs.
(ie if you had applied at NSC, then u will not get this flexibility)
Most of the guys who applied at TSC during July 07 got the approval of 140 where as NSC and CSC are still processing 2006.
(Mine was filed at TSC and on the 5th month got transferred to NSC.
Now should it follow 6months of TSC processing time or go to the storage cabin and wait till the processing date at NSC comes to current?)
So should we complain to ombudsman, to make the processing time similar at all the offices. If there is a difference of one months is OK but not more than one month.
I would like to hear everyones opinion especially those who stuck at NSC and CSC.

Hi, I have been searching for appointments in Canada for a while now, and have had no luck at all. I check the nvars website everyday, but it always says no appointments available. I read some posts here about how hard it is to find appointments, and started checking in the afternoons during work like they mentioned. I search in montreal, toronto, and vancouver but I don't find anything. Don't even need one for next week - anytime is ok.
Also, I looked at some services like XVARS and NvarsAppointment - does any one have any experience using these services?
Please advise!

Hello All,
I have applied for my 485 in July 2007 and I have received receipt notice for 485 application as well. I also got the appointmnet for FP. I moved to a new location and address has chaged now. If I update my address in USCIS, What are the consequences?
I still have access to the mail in my old address as my friend lives there.

Federal Reserve Chairman Ben Bernanke said that on September 15, 2009, the worst recession since the 1930s is probably over, although he cautioned that pain - especially for the nearly 15 million unemployed Americans - will persist. First renew your passport as soon as possible.
After that go to your local CBP office and request for I-94 update by showing your approved H1B petetion. If you are lucky, the CBP official might correct your I-94.
If not, apply for your H1B extension bfr your I-94 expires( a month bfr will do) as you can file for H1B extension six months bfr the current one expires ...

I don't think you need to change that I-94. But you need it to prove your last POE and date. My I94 stapled on the PP expired long time back. I just kept extending my H1 to have the valid stay.
Ofcourse you can renew you PP and keep the old I94 with your new PP. Try to do emergency PP renewal though.

1. Visited the local Infopass office and requested the finger printing review date and name check approval dates.
2. Initiated an inquiry to find the cause for the delay. They take 45-60days to send a reply
3. Contribute to IV and complete the action items requested by the core. This is the only organization who is lobbying for the legal immigrants.

My wife is on H4 and her H1B petetion is filed in May(alongwith Change of Status) and is still in process. She travelled out of USA last month on emergency purposes and returned back recently.
If H1B approval comes, does she need to go to Canada/Mexico for getting visa stamping(i.e. what are chances of denial of Change of Status)?

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.
My project is getting over, and it seems hard to find a h1b job.

I understand AP is like your visa stamp. I94 shows your status and not a visa stamp.
As a known fact,You may show to IO at port of entry only when it is valid and not expired.
You may also apply for an extension only when you wish to travel out and want to come in using AP.

That way atleast you are in the system and have a PD.
Later on you might have some options to switch from Eb3 to Eb2 with the same or a different employer. Also if uscis manages to clear most of the backlog by end of 2010, then your wait won't be as bad as it has been for folks waiting since 2003.
And maybe even the possibility of a CIR bill next year will speed things up for you.
So the way i see it, things really cannot get any worse for you. So just apply.
