My friend do not dream for EB3 approval until EB-2 get current. I lost my hope for GC just use EAD.

I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

I have I129 document (Petition for Nonimmigrant worker) which was valid from 10/01/07 to 09/24/2010. However i never used it. As My husband is working in US on H1b visa, i am now looking for job in US. Can you please let me know if this I129 can be used or not. I would highly appreciate early response.

Hi,
You do not even need to file AC21.. I changed my employer on EAD from H1B and no issue and got GC also.

The Council of Graduate Schools (CGS) issued an August 20, 2009 press release, reporting a decline in offers of admission from U.S. graduate schools to prospective foreign students. This is the first decline in the rate of offers to foreign students since 2004.
While these significant reductions affected the overall decline in foreign student enrollment, the number of offers of admission to students from the People's Republic of China grew at a rate of 13 percent. The CGS press release indicates that this was the fourth year in a row of double-digit growth in the number of students from China offered admission to U.S. graduate schools.
With the up coming biggest education Expo in China (http://www.phdchina.org/english/index.shtml), the US is the country of Honour at this show. This is a clear sign that Chinese students are looking at the US as the main destination for studies and future opportunities.
There is a significant economic contribution made by foreign students in tuition and related expenditures, as well. Generally, a foreign student is required to pay tuition at the much higher out-of-state rate, even when attending a state school. The potential of Chinese students boosting the economy is significant and should not be ignored. Ask your company if they can do your H1 extension under CORP thus the legal entity does not change and there should be no issue.
It seems like for your initial H1, it was a mistake on their part that they filed you H1 under CORP while you were actually paid by the BANK. Can you ask them why they did that in the first place?
If it's a mistake on their part, there's no reason why you should suffer and they must take every effort to help you out. Work with them, talk to your manager, his/her manager and explain them the issue. It's an internal thing and I'm sure can be worked out.

tanyas_21: Amendment processing time is same as normal H1 processing time. Your status is H4 until the H1B amendment (797 w/ I-94) is approved or You re-enter USA after you get your H1B stamped. USCIS usually sends cable to home consulate mentioned in I-129 about the approval of H1B - It is one of the reason, most of the attorneys' recommend people to get it stamped from home consulate. As long as you go with all the paper work, You can get it stamped from Mexico, and I dont see any issues. Do not attempt to get it stamped from Canada unless you have a verifiable US education. Gurus, My place of birth is different in my passport than that of my birth certificate. I will have the place of birth changed in my passport. Could you pls tell me how difficult/messy is to have the uscis change the place of birth in my h1b petition based on my new passport. I am currently in my second year h1b. please throw light on any possible complications both serious and trifle. I dont have my h1b visa stamped yet. My GC process is going to start soon.

I am in a difficult situation. I hope you can provide some guidance.
I am on 8th year of H1b. GC was messed up due to employer. A different employer has filed my labor 365 days before the I94 expires. I only have 3-4 months left on my current H1. I might have problems with my H1 transfer on time due to this new memo as I am working in layers, and I might loose my H1 status.
My wife is on F1 visa and I would like to know if
1) I can get H1 to F2 transfer. I have all recent paychecks etc and still working?
2) If I get F2, can I find a new employer who can sponsor my H1 (full time not a consultant) while in US and then do F2 to H1. I am assuming this will be a new term of H1 within the limits of the quota etc.
OR
I have to go back to my country for 1 year if I want to be on H1 again? Here I am assuming that I can re-enter the country on F2 visa then find a new sponsor. Do you see any problems with the above?

I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays.This is my understanding.
Same thing at Indian consulates. I
f the rules have changed Please enlighten me the folks who knows about it.
