    You might have got classified as an Electrical Engineer by TWC, and likely Level 4 with 5 years experience as a requirement. If 5 years is really the requirement, and if you are an electrical engineer, or have an EE degree, TWC usually gives this designation. It is difficult to overcome this. Your friends who had lower prevailing wages must have been in different locations or had different occupations, or both. If your lawyer has lots of experience doing PERM, you can probably trust him.

    I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
    I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

    Is there any specific PERM requirement as to how many days does the job posting need to be posted on a job search website like monster.com?

    For some reason, I thought that it was required for the job to be posted for at least 30 days but I can't find out the source.

    The USCIS Webmaster has returned to work. His EAD must have expired on Friday hence the site must have gone down, but the new one is approved and hence the site is up.

    Hi, I applied for my green card (NY state) and have my priority date as 09/25/2003. I see the status as Pending on the backlog elimination center website. I have still not received any updates from them. My lawyers said they are still waiting to hear back from the BEC. Have they started processing Sep 2003 applications at this point?

    My employer filled EB-2 PERM for me on 12/2007.
    My I-140 is approved on 07/2008.
    Now I am worry about losing my job.
    If this happens, maybe I will switch to NIW pathway later.
    Now I wonder whether NIW can use the PD of PERM?
    My attorney is not sure about this.

    Anyone here succeed in this?

    Simple answer is "YES YOU CAN" :)
    But start on your NIW case soon, it is much easier to get NIW done if you have a job while applying. Also there is no premium processing for NIW yet, so work on it now, dont wait till you get laid off.

    Additionally, get a good attorney! NIW case requires a "VERY good attorney", not the one who is not sure of some simple thing like porting of PD.

    The U.S Department of State (DOS) has advised that there are no more employment-based visa numbers available for fiscal year 2009, which concludes September 30, 2009. This affects all employment based categories, but particularly applicants in the employment-based non-ministerial fourth category (EB-4). The EB-4 non-ministerial category includes religious occupation, vocation and professional categories (but not the ministerial category).

    The non-ministerial EB-4 category is set to expire September 30, 2009 and individuals in this category must have their adjustment of status applications approved or if they applied via consular processing, they must be admitted into the United States by midnight by September 30, 2009. Unless Congress extends the sunset provision, individuals in the EB-4 non-ministerial category are unable to file Form I-485 Adjustment of Status Applications or consular processing applications after September 30, 2009.

    While the I-360 religious worker petitions (ministerial and non-ministerial categories) may still be filed before September 30, 2009, given the unavailability of visas in the EB-4 category the month of September, the Applications to Adjust Status (Form I-485) or applications for consular processing will not be accepted this month. Thus, adjustment of status applications that remained pending will not be approved unless a visa number had already been captured.

    Individuals in the EB-4 ministerial category are eligible to file Adjustment of Status applications until October 1, 2009, when visas in the EB-4 category become available.     Hi,

    Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

    I don't know if the following information is applicable if the GC is denied.

    Last year, my friend started working on an EAD (after his H-1B visa expired). Unfortunately, he did not get his renewal EAD in hand before the expiry of the current EAD, so the lawyer submitted a H-1B petition to use the unused portion (India vacations for him, but basically any time when you were outside the US) from his old H-1B so my friend could continue working. If I remember well, it was applied under Premium Processing, but I know for sure that it definitely came through. But so did his EAD card...on the day his current EAD expired.

    Again, I want to reiterate that I don't know how the above scenario plays out if the GC is denied, so do check with a lawyer.

    There are plenty.. but they cost money... and usually quite a bit. 3D designers think that they have some specialy skills or something. I've not yet found any free ones.. the one's I have seen run upwards of a couple thousand dollars.

    Today my lawyer sent me my receipt numbers for 485, EAD and AP. when I enter my AP receipt number to check online status I see the following...

    Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION

    Current Status: Card production ordered.

    On August 30, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

    Anyone know what this means... It doesn't say I-131 in application type..

    Second disturbing thing I noticed when I entered my 485 number...

    Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Fingerprint fee rejected and notice mailed; case in suspense.

    On August 23, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense. Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.

    My lawyer says the checks have been cashed and we have proof of this.. She says it can be a typo..
    Most weird part is for my EAD it says card has been ordered.. but I haven't even done finger prints and my 485 is in suspense..

    Anyone any idea whats happening.. should I be worried about OS155A and 485 things..

    Yes, its possible. The only conditions are - your port of entry MUST be Newark, NJ & you MUST rent the apartment at Whitehall Gardens, Somerset.

    If you dont meet any of these, USCIS will not allow you to convert from visitor to H1B
