I did about 3 APs and EADs myself this is not so important. I had left it blank. The most important thing I remember is my EAD got rejected was when I picked the wrong section for the Basis of EAD (which is a bunch of codes). Please make sure you pick the right one here, if your in doubt dont fill the form till you know the exact answer.

We did the exact same thing. We informed officer that my wife's Extension is pending, he said that's fine and gave her I-94 valid for 40 days (time remaining on her H4 visa).

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

Wait time for spouse to get a green card as a derivative from you would be apporximately 5 years since you already have your green card now. the best option is to wait for to get your US citizenship and them apply for your spouse and in that case the max. wait time os only 3-6 months. Hoep this helps.

I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

All Employment Based green cards must be filed/sponsored by an employer.
You cannot file by yourself.

The first picture isn't as good as the others, because it's too dark in the face. You need to wait for the light to hit their face some, and then snap. Harder to do, than to recommend, really.
Can't really comment on the others.
[And by no means saying I would have come up with anything as good or better].

Hi all,
I understand there have been several threads in the past discussing the use of EAD for part time work while using H1 for the full time job. There were different views expressed by the group at that time.

I am getting ready to n-470 to preserve residency. My company is sending me to UAE for one week period which will leads to other long back and forth trips there. I need to file n-470 to preserve residency for naturalization. I have already lived here for more than one year as a permanent resident. My questions are:
1. Where do I find a sample communication letter as a support document?
2. What do I write in it?

Hi,
my original labor got approved with a PD in July 2007 with Company A who is my current employer. I also applied for a seperate 140 based on a pre-approved labor in July 2007 with Company B and the PD for that labor is in 2005.
i was told that i can apply for 140/485 with my original labor and once the 140 for the pre-approved labor is approved, i can request for replacing the 140 with the other one with an earlier PD.
could any one repalce the 140 like this? if yes, how long it took for the process. does both 140 needs to be approved to do the interfiling?
what details we need for the 140 that we want to use. just the filing date, A# & approval date or the original or copy of the approval notice.
if Company B or its attoreny is not willing to provide the 140 details or approval notice, is there any way to get those details from INS.
i dont have any details with me except that i know that they applied for 140.

In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".
My Employer wants to reply that this was a clerical mistake..... Is this right? or should he file a new petition.
Can I file another petition if this petition is rejected?

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....
Hope this story helps.

Hi I have H1 papers from my last extension valid until June 15.
I haven't traveled during this period but planning to visit India Between March20 and April 20. So I will have to visit US embassy for stamping.
Can someone please let me know the risk associated with going for stamping with H1 only valid for 2 months.
I am applying for an extension but I will not receive the extension papers until May and do not want to wait until then as this will be my last extension until Dec.
Please advice if its safe to go to US consulate in India for stamping with only 2 months validity on my H1.

You need to file a COS from H-4 to H-1B. You cannot work until the H-1B is approved, because you are not in H-1B status now and therefore cannot use H-1B portability rules. You will not be subject to the cap since you have held H-1B status withing the past 6 years, and presumably not used a full 6 years.
Whether your last employer or a new employer files for a new H-1B status for you, it is still a new filing and any prior filings are not relevant, except to show that you are not subject to the cap.
By the way - this might get more comments if posted in the Nonimmigrant Visa section of the forum.
