I dont think the situation is that bleak. What would happen when EB3 ROW is unable to use up all the spillovers from EB2? The excess would go to EB3 I, right?

What you are asking for is "verticle spill" till it comes to EB3 ROW and then spill it "horizontally" to EB3 I, then only EB3 I would benefit. (although USCIS did this in the past, there is no logic that can explain it)

Dilips post is fine only in parts but most of it is totally crap. He says his living standard has gone down because of L1s and H1bs and herds people coming from india, Dude you need to understand that this recession has not been caused by H1b and L1s or other IT workers coming to US, its because of the real estate boom and foolishness of american people who believed that real estate prices will keep on rising to INFINITY.. i don't have to explain how this recession started i hope majority of the people knows about it.. so stop blaming IT workforce for your living standard.. another example.. just seen what happened to GM and chrysler.. they failed to understand the market for small cars and fuel efficient cars.. instead they produced gas guzzlers like hummers.. so do you think they have the brightest minds. I wished i was that bright and intelligent person to predict July 07 fiasco but unfortunately i quit my company in Mar 07.. and i know some people who used subsititued labor in July 07 have their EADs with them. Don't think just by getting a GC or citizenship will certify that your the brightest of all still waiting in the GC queue. I am not sure how many people believe in luck... but i do. I don't matter how bright you are and how hard you work you need some luck also..

The moral is GC comes to those who are lucky and apply for it. Its not true that always the best and brightest will only get GC. If the person is technically good or has good apptitue the best he can do is hang on to his job for years and also pray that his company doesn't go bankrupt (there is not fault of this bright employee :D in this case). Dilip was talking about some flush, this flush will wash all the bad apples and also some good apples.. good people also leave after getting frustrated with immigration system (of this developed nation, which doesn't keep track of its visa numbers, moves dates forward backwards by two years :D big joke They can't even predict visa dates. ) Instead of coming up with bill for fixing the credit market and financial system, he(Grassley) should concentrate more on strict reforms and more regulation for financial system, the root cause of recession instead of beating around the bush with immigration system.. He is trying to use the emotion of the local people.. those who have GC fall for such policies because they know they are ahead in the queue and more jobs will be available to them if few IT works immigrate (There are lot of jobs for citizens and GC only). I wished alteast the ones who have suffered throughout this GC journey will understand the pain of other people. Getting a GC should not change the attitude completely.

I had my candadian immigration last year. And the dead line to land was March 2007.
I was very confuse at that time about landing in Canada. Then one day my old 2002 PD labor got approved and I filed 485 in March 07. But now my canadian Immigration is expired.
Even my 485 is filed, I am thinking again to apply fresh application for Canadian Immigration. You never know what will happen to GC. So I will file again by the end of this year for Canadian Immigration.

If we those who have worked here, paid taxes , abided the law, followed the law of land once we return from India many of us have been questioned. Though as per us nothing might have changed like employer, salary, position, residential address etc etc... still many of our friends are detainted and asked to proved documental proof....{If we who have stayed here for years are detained} then why not SRK or any other person.....
After staying here for 9 years, I was detained in 2007 for 1 hour for questioning.....that way US has more proof about me for past 9 years then SRK or any other Indian bollywood stars....

Tamils live the same life as Sinhala and Muslims, if you're visited sri lanka you would see that. Schools are open to everyone within their respective distances, tamils conduct business same as muslims and sinhala. What you're discussing is something that happened when the country was given independance and the sinhala policy came into act. great to see someone welcoming immigrants. My wife is a dentist, licensed in one state of the USA. However she does not have a US DDS. She was licensed by the state as she has great experience and she passed all the tests needed. She has been very well practising dentistry for almost 2.5-3 years now in the US. However, Canada does not let internationally trained dentists get licensed without going to Canadian/American dental school. If you know of any place in CA which would license my wife as she has more than 7 years of exp (4+in India, alomst 3 in USA) and had passed all exams (Board, licensing etc etc), please let me know. That is the single most imp reason for me to still hang im here.

Every country has its warts. (Mine has them too) but the immigrants to a country are what give it life.
For the Doctors, check out some rural areas various provinces. I think they have programs that ease the regulatory burden.

Why: Possibly the only near term solution to retrogression. 218,759 visas are available for recapture and those numbers were lost due to systematic agency delays and bad policies (i.e. name check). The terms of settlement would include RECAPTURE OF LOST VISAS along with recovery of cost of litigation. Apparently, about 50 asylees have filed a similar lawsuit to challenge the retrogression in their category.
Who: All thos who are willing to make this change. You indicate your willingness and support by saying 'Yes' in the poll above. The poll above is just a headcount. We are hoping we can count on you for support.
How: We can kick this off with an initial consultation with an attorney. A $$ collection will soon be organized depending on the support expressed in the poll.
Can we do it? Yes... If we can come to this great country with just 2 bags in our hands and create a life for us here... we can totally do this.
NOTE: IV core forever rocks in our books for what they did relating to July 2nd. IV's agenda cannot be discounted. The bigger PITA (pain-in-the-ass) you are... the higher is the priority you get.

USCIS says EBs are retrogressed because there are XXXXX people in the queue. Why is the queue so long? Because they wasted numbers in the past and kept the queue long. This is pure operational inefficiency that is resulting in monetary, emotional and mental loss to about a million people.
This is a valid ground for a class action lawsuit.
By filing this suit, we will become the "cactii in the colon" that they will have to address. And you know what the easy out of court settlement will be..... RECAPTURE!
We will keep lobbying and crying as we usually do.. But this thing has a far better shot than anything else.

I just read through this thread and made some interesting observations.
We all have our own opinions and I am bringing all this into context by considering the fact that most people on this thread are people of Indian origin.
So here is my opinion too.
Looks like there is a process followed by the security officials that flags people based on certain factors.
Now, we can talk for hours and discuss and debate - but we really don't know how such a system is working. It might be working great in the POV of some people who claim that it helps with filtering out the terrorists.
If it is a frequest occurance and is affecting everyone - then there is definitely issues with such a system - but do we hear such stories regularly? We don't. We hear stories of Abdul Kalam or Shilpa Shetty or Sharukh Khan because they are celebrities.
It might be happening quite often and we never know.
It looks like a lot of "discretionary" power lies in the hands of these officers and at times they may just not listen or heed to anyone.
In my opinion a "discretionary" power is something that needs to be associated with good judgement. Rules and systems are in place to "help with things in a good way" and need not be the other way.
If someone feels bad about something - it is not their fault as one cannot control one's feelings. This is exactly what President Obama explained at the "beer summit"
In the modern world the definition of racism has changed. There is nothing called racism or discrimination which relate to their original meanings. For eg.. Indian students in Australia not necessarily be attacked by a particulal race - most time they are attacked by a mob of different kinds of people.
In reality "all of us are living in today's world where there are issues - some are vocal about it, some deny it, some supportit and some oppose it.
Lets think like a cynic - cynical people are good thinkers because all those cynics out there have become so due to series of different experiences the eventually changes the way they think.
We all have our own opinions and I am bringing all this into context by considering the fact that most people on this thread are people of Indian origin.
So here is my opinion too.
Looks like there is a process followed by the security officials that flags people based on certain factors.
Now, we can talk for hours and discuss and debate - but we really don't know how such a system is working. It might be working great in the POV of some people who claim that it helps with filtering out the terrorists.
If it is a frequest occurance and is affecting everyone - then there is definitely issues with such a system - but do we hear such stories regularly? We don't. We hear stories of Abdul Kalam or Shilpa Shetty or Sharukh Khan because they are celebrities.
It might be happening quite often and we never know.
It looks like a lot of "discretionary" power lies in the hands of these officers and at times they may just not listen or heed to anyone.
In my opinion a "discretionary" power is something that needs to be associated with good judgement. Rules and systems are in place to "help with things in a good way" and need not be the other way.
If someone feels bad about something - it is not their fault as one cannot control one's feelings. This is exactly what President Obama explained at the "beer summit"
In the modern world the definition of racism has changed. There is nothing called racism or discrimination which relate to their original meanings. For eg.. Indian students in Australia not necessarily be attacked by a particulal race - most time they are attacked by a mob of different kinds of people.

I have joined immigrationvoice today. I did contact all the major newspapers in Utah. I was called back by DeseretNews. I was called back and gave almost and hour of interview (more than one call). The story publication in Deseretnews is imminent on July 4 or 5.

The Dept of State and Dept of Homeland Security(USCIS) acted against the interests of immigrants trying to immigrate legally. Legal immigration is the real issue. If it works, there
will not be a need to grant amnesty to millons of illegal alilens. The real solution to stop
illegal immigration is to make legal immigration work. Unfortunately, the government is going
in the opposite direction as evident by the actions of DOS and DOHS on July 2, 2007.
I would be happy if you would be kind enough to publish this story and bring the issue
of legal immigration to light. After all, thats what everybody wants, immigration to be
orderly and legal, but is it workable ? and why people trying to follow the law feel
cheated and duped by the government, after waiting patiently for years and abiding to
the laws.
